99 relating to standing for certain foster parents to file a suit
1010 affecting the parent-child relationship.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 102.003(a), Family Code, is amended to
1313 read as follows:
1414 (a) An original suit may be filed at any time by:
1515 (1) a parent of the child;
1616 (2) the child through a representative authorized by
1717 the court;
1818 (3) a custodian or person having the right of
1919 visitation with or access to the child appointed by an order of a
2020 court of another state or country;
2121 (4) a guardian of the person or of the estate of the
2222 child;
2323 (5) a governmental entity;
2424 (6) an authorized agency;
2525 (7) a licensed child placing agency;
2626 (8) a man alleging himself to be the father of a child
2727 filing in accordance with Chapter 160, subject to the limitations
2828 of that chapter, but not otherwise;
2929 (9) a person, other than a foster parent, who has had
3030 actual care, control, and possession of the child for at least six
3131 months ending not more than 90 days preceding the date of the filing
3232 of the petition;
3333 (10) a person designated as the managing conservator
3434 in a revoked or unrevoked affidavit of relinquishment under Chapter
3535 161 or to whom consent to adoption has been given in writing under
3636 Chapter 162;
3737 (11) a person with whom the child and the child's
3838 guardian, managing conservator, or parent have resided for at least
3939 six months ending not more than 90 days preceding the date of the
4040 filing of the petition if the child's guardian, managing
4141 conservator, or parent is deceased at the time of the filing of the
4242 petition;
4343 (12) a person who is the foster parent of a child
4444 placed by the Department of Family and Protective [and Regulatory]
4545 Services in the person's home for at least:
4646 (A) 12 months ending not more than 90 days
4747 preceding the date of the filing of the petition; or
4848 (B) six months ending not more than 90 days
4949 preceding the date of the filing of the petition if the department
5050 has removed the child from the child's home more than once;
5151 (13) a person who is a relative of the child within the
5252 third degree by consanguinity, as determined by Chapter 573,
5353 Government Code, if the child's parents are deceased at the time of
5454 the filing of the petition; or
5555 (14) a person who has been named as a prospective
5656 adoptive parent of a child by a pregnant woman or the parent of the
5757 child, in a verified written statement to confer standing executed
5858 under Section 102.0035, regardless of whether the child has been
5959 born.
6060 SECTION 2. The change in law made by this Act applies only
6161 to a suit affecting the parent-child relationship filed on or after
6262 the effective date of this Act. A suit filed before that date is
6363 governed by the law in effect on the date the suit was filed, and the
6464 former law is continued in effect for that purpose.
6565 SECTION 3. This Act takes effect September 1, 2011.
