88 relating to the addition of Salvia divinorum and its derivatives
99 and extracts to Penalty Group 3 of the Texas Controlled Substances
1010 Act.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 481.104(a), Health and Safety Code, is
1313 amended to read as follows:
1414 (a) Penalty Group 3 consists of:
1515 (1) a material, compound, mixture, or preparation that
1616 contains any quantity of the following substances having a
1717 potential for abuse associated with a stimulant effect on the
1818 central nervous system:
1919 Methylphenidate and its salts; and
2020 Phenmetrazine and its salts;
2121 (2) a material, compound, mixture, or preparation that
2222 contains any quantity of the following substances having a
2323 potential for abuse associated with a depressant effect on the
2424 central nervous system:
2525 a substance that contains any quantity of a
2626 derivative of barbituric acid, or any salt of a derivative of
2727 barbituric acid not otherwise described by this subsection;
2828 a compound, mixture, or preparation containing
2929 amobarbital, secobarbital, pentobarbital, or any salt of any of
3030 these, and one or more active medicinal ingredients that are not
3131 listed in any penalty group;
3232 a suppository dosage form containing amobarbital,
3333 secobarbital, pentobarbital, or any salt of any of these drugs, and
3434 approved by the United States Food and Drug Administration for
3535 marketing only as a suppository;
3636 Alprazolam;
3737 Amobarbital;
3838 Bromazepam;
3939 Camazepam;
4040 Chlordiazepoxide;
4141 Chlorhexadol;
4242 Clobazam;
4343 Clonazepam;

9191 Triazolam;
9292 Zaleplon;
9393 Zolpidem; and
9494 Zopiclone;
9595 (3) Nalorphine;
9696 (4) a material, compound, mixture, or preparation
9797 containing limited quantities of the following narcotic drugs, or
9898 any of their salts:
9999 not more than 1.8 grams of codeine, or any of its
100100 salts, per 100 milliliters or not more than 90 milligrams per dosage
101101 unit, with an equal or greater quantity of an isoquinoline alkaloid
102102 of opium;
103103 not more than 1.8 grams of codeine, or any of its
104104 salts, per 100 milliliters or not more than 90 milligrams per dosage
105105 unit, with one or more active, nonnarcotic ingredients in
106106 recognized therapeutic amounts;
107107 not more than 300 milligrams of dihydrocodeinone
108108 (hydrocodone), or any of its salts, per 100 milliliters or not more
109109 than 15 milligrams per dosage unit, with a fourfold or greater
110110 quantity of an isoquinoline alkaloid of opium;
111111 not more than 300 milligrams of dihydrocodeinone
112112 (hydrocodone), or any of its salts, per 100 milliliters or not more
113113 than 15 milligrams per dosage unit, with one or more active,
114114 nonnarcotic ingredients in recognized therapeutic amounts;
115115 not more than 1.8 grams of dihydrocodeine, or any
116116 of its salts, per 100 milliliters or not more than 90 milligrams per
117117 dosage unit, with one or more active, nonnarcotic ingredients in
118118 recognized therapeutic amounts;
119119 not more than 300 milligrams of ethylmorphine, or
120120 any of its salts, per 100 milliliters or not more than 15 milligrams
121121 per dosage unit, with one or more active, nonnarcotic ingredients
122122 in recognized therapeutic amounts;
123123 not more than 500 milligrams of opium per 100
124124 milliliters or per 100 grams, or not more than 25 milligrams per
125125 dosage unit, with one or more active, nonnarcotic ingredients in
126126 recognized therapeutic amounts;
127127 not more than 50 milligrams of morphine, or any of
128128 its salts, per 100 milliliters or per 100 grams with one or more
129129 active, nonnarcotic ingredients in recognized therapeutic amounts;
130130 and
131131 not more than 1 milligram of difenoxin and not
132132 less than 25 micrograms of atropine sulfate per dosage unit;
133133 (5) a material, compound, mixture, or preparation that
134134 contains any quantity of the following substances:
135135 Barbital;
136136 Chloral betaine;
137137 Chloral hydrate;
138138 Ethchlorvynol;
139139 Ethinamate;
140140 Meprobamate;
141141 Methohexital;
142142 Methylphenobarbital (Mephobarbital);
143143 Paraldehyde;
144144 Petrichloral; and
145145 Phenobarbital;
146146 (6) Peyote, unless unharvested and growing in its
147147 natural state, meaning all parts of the plant classified
148148 botanically as Lophophora, whether growing or not, the seeds of the
149149 plant, an extract from a part of the plant, and every compound,
150150 manufacture, salt, derivative, mixture, or preparation of the
151151 plant, its seeds, or extracts;
152152 (7) unless listed in another penalty group, a
153153 material, compound, mixture, or preparation that contains any
154154 quantity of the following substances having a stimulant effect on
155155 the central nervous system, including the substance's salts,
156156 optical, position, or geometric isomers, and salts of the
157157 substance's isomers, if the existence of the salts, isomers, and
158158 salts of isomers is possible within the specific chemical
159159 designation:
160160 Benzphetamine;
161161 Cathine [(+)-norpseudoephedrine];
162162 Chlorphentermine;
163163 Clortermine;
164164 Diethylpropion;
165165 Fencamfamin;
166166 Fenfluramine;
167167 Fenproporex;
168168 Mazindol;
169169 Mefenorex;
170170 Modafinil;
171171 Pemoline (including organometallic complexes and
172172 their chelates);
173173 Phendimetrazine;
174174 Phentermine;
175175 Pipradrol;
176176 Sibutramine; and
177177 SPA [(-)-1-dimethylamino-1,2-diphenylethane];
178178 (8) unless specifically excepted or unless listed in
179179 another penalty group, a material, compound, mixture, or
180180 preparation that contains any quantity of the following substance,
181181 including its salts:
182182 Dextropropoxyphene (Alpha-(+)-4-dimethylamino-
183183 1,2-diphenyl-3-methyl-2-propionoxybutane); [and]
184184 (9) an anabolic steroid, including any drug or
185185 hormonal substance, or any substance that is chemically or
186186 pharmacologically related to testosterone, other than an estrogen,
187187 progestin, dehydroepiandrosterone, or corticosteroid, and promotes
188188 muscle growth, including the following drugs and substances and any
189189 salt, ester, or ether of the following drugs and substances:

194194 Bolasterone;
195195 Boldenone;
196196 Calusterone;

248248 SECTION 2. This Act takes effect September 1, 2011.
