8	8	relating to the addition of Salvia divinorum and its derivatives
9	9	and extracts to Penalty Group 3 of the Texas Controlled Substances
10	10	Act.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 481.104(a), Health and Safety Code, is
13	13	amended to read as follows:
14	14	(a) Penalty Group 3 consists of:
15	15	(1) a material, compound, mixture, or preparation that
16	16	contains any quantity of the following substances having a
17	17	potential for abuse associated with a stimulant effect on the
18	18	central nervous system:
19	19	Methylphenidate and its salts; and
20	20	Phenmetrazine and its salts;
21	21	(2) a material, compound, mixture, or preparation that
22	22	contains any quantity of the following substances having a
23	23	potential for abuse associated with a depressant effect on the
24	24	central nervous system:
25	25	a substance that contains any quantity of a
26	26	derivative of barbituric acid, or any salt of a derivative of
27	27	barbituric acid not otherwise described by this subsection;
28	28	a compound, mixture, or preparation containing
29	29	amobarbital, secobarbital, pentobarbital, or any salt of any of
30	30	these, and one or more active medicinal ingredients that are not
31	31	listed in any penalty group;
32	32	a suppository dosage form containing amobarbital,
33	33	secobarbital, pentobarbital, or any salt of any of these drugs, and
34	34	approved by the United States Food and Drug Administration for
35	35	marketing only as a suppository;
36	36	Alprazolam;
37	37	Amobarbital;
38	38	Bromazepam;
39	39	Camazepam;
40	40	Chlordiazepoxide;
41	41	Chlorhexadol;
42	42	Clobazam;
43	43	Clonazepam;

105	105	unit, with one or more active, nonnarcotic ingredients in
106	106	recognized therapeutic amounts;
107	107	not more than 300 milligrams of dihydrocodeinone
108	108	(hydrocodone), or any of its salts, per 100 milliliters or not more
109	109	than 15 milligrams per dosage unit, with a fourfold or greater
110	110	quantity of an isoquinoline alkaloid of opium;
111	111	not more than 300 milligrams of dihydrocodeinone

113	113	than 15 milligrams per dosage unit, with one or more active,
114	114	nonnarcotic ingredients in recognized therapeutic amounts;
115	115	not more than 1.8 grams of dihydrocodeine, or any
116	116	of its salts, per 100 milliliters or not more than 90 milligrams per
117	117	dosage unit, with one or more active, nonnarcotic ingredients in
118	118	recognized therapeutic amounts;
119	119	not more than 300 milligrams of ethylmorphine, or
120	120	any of its salts, per 100 milliliters or not more than 15 milligrams
121	121	per dosage unit, with one or more active, nonnarcotic ingredients
122	122	in recognized therapeutic amounts;
123	123	not more than 500 milligrams of opium per 100
124	124	milliliters or per 100 grams, or not more than 25 milligrams per
125	125	dosage unit, with one or more active, nonnarcotic ingredients in
126	126	recognized therapeutic amounts;
127	127	not more than 50 milligrams of morphine, or any of
128	128	its salts, per 100 milliliters or per 100 grams with one or more
129	129	active, nonnarcotic ingredients in recognized therapeutic amounts;

131	131	not more than 1 milligram of difenoxin and not
132	132	less than 25 micrograms of atropine sulfate per dosage unit;
133	133	(5) a material, compound, mixture, or preparation that
134	134	contains any quantity of the following substances:

137	137	Chloral hydrate;
138	138	Ethchlorvynol;
139	139	Ethinamate;
140	140	Meprobamate;
141	141	Methohexital;
142	142	Methylphenobarbital (Mephobarbital);

146	146	(6) Peyote, unless unharvested and growing in its
147	147	natural state, meaning all parts of the plant classified
148	148	botanically as Lophophora, whether growing or not, the seeds of the
149	149	plant, an extract from a part of the plant, and every compound,
150	150	manufacture, salt, derivative, mixture, or preparation of the
151	151	plant, its seeds, or extracts;
152	152	(7) unless listed in another penalty group, a
153	153	material, compound, mixture, or preparation that contains any
154	154	quantity of the following substances having a stimulant effect on
155	155	the central nervous system, including the substance's salts,
156	156	optical, position, or geometric isomers, and salts of the
157	157	substance's isomers, if the existence of the salts, isomers, and
158	158	salts of isomers is possible within the specific chemical
159	159	designation:
160	160	Benzphetamine;
161	161	Cathine [(+)-norpseudoephedrine];
162	162	Chlorphentermine;
163	163	Clortermine;
164	164	Diethylpropion;
165	165	Fencamfamin;
166	166	Fenfluramine;
167	167	Fenproporex;
168	168	Mazindol;

189	189	salt, ester, or ether of the following drugs and substances:

248	248	SECTION 2. This Act takes effect September 1, 2011.
