 A BILL TO BE ENTITLED
 AN ACT
 relating to foster care payments for certain children.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 264.101(a-2), Family Code, is amended to
 read as follows:
 (a-2)  The department shall continue to pay the cost of
 foster care under:
 (1)  Subsection (a-1)(1) until:
 (A)  the last day of the third full month after the
 date the child receives a high school diploma or high school
 equivalency certificate; or
 (B)  the last day of the month in which the child
 attains the age of 22 if the child has not received a high school
 diploma or high school equivalency certificate; and
 (2)  Subsections (a-1)(2)-(5) until the last day of the
 month the child attains the age of 21.
 SECTION 2.  The change in law made by this Act applies to
 foster care payments for a child who is in foster care on or after
 the effective date of this Act.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
