| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 43.352(b), Parks and Wildlife Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (b) At the option of the person applying for the issuance or |
|---|
| 14 | 14 | | renewal of a permit under this section, the [The] department may |
|---|
| 15 | 15 | | issue a permit [under this section] that is valid for [longer than] |
|---|
| 16 | 16 | | one year, three years, or five years. A three-year or five-year |
|---|
| 17 | 17 | | permit is available only to a person who agrees to submit the annual |
|---|
| 18 | 18 | | reports required under this subchapter electronically. The |
|---|
| 19 | 19 | | commission may adopt rules allowing the department to terminate a |
|---|
| 20 | 20 | | permit before the date originally specified for the permit issuance |
|---|
| 21 | 21 | | or renewal if the permit holder fails to submit the annual reports |
|---|
| 22 | 22 | | electronically as required for a three-year or five-year permit. |

| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2011. |
