13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. This Act shall be known as the Britteny Sage |
---|
15 | 15 | | Lindt Act. |
---|
16 | 16 | | SECTION 2. The heading to Section 31.099, Parks and |
---|
17 | 17 | | Wildlife Code, is amended to read as follows: |
---|
18 | 18 | | Sec. 31.099. PROHIBITION ON CIRCULAR COURSE AROUND |
---|
19 | 19 | | INDIVIDUALS ENGAGED IN WATER ACTIVITIES [FISHERMAN OR SWIMMER]. |

20 | 20 | | SECTION 3. Section 31.099, Parks and Wildlife Code, is |
---|
21 | 21 | | amended by amending Subsection (a) and adding Subsection (a-1) to |
---|
22 | 22 | | read as follows: |
---|
23 | 23 | | (a) No person may operate a motorboat in a circular course |
---|
24 | 24 | | around: |
---|
25 | 25 | | (1) any other boat or personal watercraft any occupant |
---|
26 | 26 | | of which is engaged in fishing, waterskiing, or a similar activity; |
---|
27 | 27 | | or |
---|
28 | 28 | | (2) [around] any person swimming. |
---|
29 | 29 | | (a-1) Subsection (a) does not apply to a person operating a |
---|
30 | 30 | | motorboat in a circular course to retrieve a downed or fallen |
---|
31 | 31 | | water-skier or other person engaged in a similar activity. |
---|
32 | 32 | | SECTION 4. The change in law made by this Act applies only |
---|
33 | 33 | | to an offense committed on or after the effective date of this Act. |
---|
34 | 34 | | An offense committed before the effective date of this Act is |
---|
35 | 35 | | covered by the law in effect when the offense was committed, and the |
---|
36 | 36 | | former law is continued in effect for that purpose. For purposes of |
---|
37 | 37 | | this section, an offense was committed before the effective date of |
---|
38 | 38 | | this Act if any element of the offense was committed before that |
---|
39 | 39 | | date. |
---|
40 | 40 | | SECTION 5. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2011. |
