99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to offenses involving operating a motorboat in a circular
1212 course.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. This Act shall be known as the Britteny Sage
1515 Lindt Act.
1616 SECTION 2. The heading to Section 31.099, Parks and
1717 Wildlife Code, is amended to read as follows:
1818 Sec. 31.099. PROHIBITION ON CIRCULAR COURSE AROUND
1919 INDIVIDUALS ENGAGED IN WATER ACTIVITIES [FISHERMAN OR SWIMMER].
2020 SECTION 3. Section 31.099, Parks and Wildlife Code, is
2121 amended by amending Subsection (a) and adding Subsection (a-1) to
2222 read as follows:
2323 (a) No person may operate a motorboat in a circular course
2424 around:
2525 (1) any other boat or personal watercraft any occupant
2626 of which is engaged in fishing, waterskiing, or a similar activity;
2727 or
2828 (2) [around] any person swimming.
2929 (a-1) Subsection (a) does not apply to a person operating a
3030 motorboat in a circular course to retrieve a downed or fallen
3131 water-skier or other person engaged in a similar activity.
3232 SECTION 4. The change in law made by this Act applies only
3333 to an offense committed on or after the effective date of this Act.
3434 An offense committed before the effective date of this Act is
3535 covered by the law in effect when the offense was committed, and the
3636 former law is continued in effect for that purpose. For purposes of
3737 this section, an offense was committed before the effective date of
3838 this Act if any element of the offense was committed before that
3939 date.
4040 SECTION 5. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2011.
