14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Section 151.105(d), Natural Resources Code, is |
---|
16 | 16 | | amended to read as follows: |
---|
17 | 17 | | (d) An offense under this section is: |
---|
18 | 18 | | (1) a state jail felony if it is shown on the trial of |
---|
19 | 19 | | the offense that the value of the timber sold is at least $500 but |
---|
20 | 20 | | less than $20,000; |
---|
21 | 21 | | (2) a felony of the third degree if it is shown on the |
---|
22 | 22 | | trial of the offense that the value of the timber sold is at least |
---|
23 | 23 | | $20,000 but less than $100,000; |
---|
24 | 24 | | (3) a felony of the second degree if it is shown on the |
---|
25 | 25 | | trial of the offense that the value of the timber sold is at least |
---|
26 | 26 | | $100,000 but less than $200,000; or |
---|
27 | 27 | | (4) a felony of the first degree if it is shown on the |
---|
28 | 28 | | trial of the offense that the value of the timber sold is at least |
---|
29 | 29 | | $200,000. |
---|
30 | 30 | | SECTION 2. The change in law made by this Act applies only |
---|
31 | 31 | | to an offense committed on or after the effective date of this Act. |
---|
32 | 32 | | An offense committed before the effective date of this Act is |
---|
33 | 33 | | governed by the law in effect on the date the offense was |
---|
34 | 34 | | committed, and the former law is continued in effect for that |
---|
35 | 35 | | purpose. For purposes of this section, an offense was committed |
---|
36 | 36 | | before the effective date of this Act if any element of the offense |
---|
37 | 37 | | occurred before that date. |
---|
38 | 38 | | SECTION 3. This Act takes effect September 1, 2011. |
