| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 501.093(a), Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (a) If an insurance company pays a claim on a nonrepairable | |
| 13 | 13 | motor vehicle or salvage motor vehicle and the insurance company | |
| 14 | 14 | does not acquire ownership of the motor vehicle, the insurance | |
| 15 | 15 | company shall: | |
| 16 | 16 | (1) submit to the department, before the 31st day | |
| 17 | 17 | after the date of the payment of the claim, on the form prescribed | |
| 18 | 18 | by the department, a report stating that the insurance company: | |
| 19 | 19 | (A) [(1)] has paid a claim on the motor vehicle; | |
| 20 | 20 | and | |
| 21 | 21 | (B) [(2)] has not acquired ownership of the motor | |
| 22 | 22 | vehicle; and | |
| 23 | 23 | (2) provide notice to the owner of the motor vehicle | |
| 24 | 24 | of: | |
| 25 | 25 | (A) the report required under Subdivision (1); | |
| 26 | 26 | and | |
| 27 | 27 | (B) the requirements for operation or transfer of | |
| 28 | 28 | ownership of the motor vehicle under Subsection (b). | |
| 29 | 29 | SECTION 2. This Act takes effect September 1, 2011. |
