| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife |
|---|
| 15 | 15 | | Code, is amended by adding Section 12.012 to read as follows: |
|---|
| 16 | 16 | | Sec. 12.012. RECREATIONAL WATER SAFETY VIDEO. (a) The |
|---|
| 17 | 17 | | department shall produce a video suitable for use with high school |
|---|
| 18 | 18 | | students on recreational water safety. The video must include |
|---|
| 19 | 19 | | instruction on safe participation in recreational activities in, |
|---|
| 20 | 20 | | on, or around the lakes, rivers, and coastal waters of this state. |

| 21 | 21 | | (b) The department shall notify the Texas Education Agency |
|---|
| 22 | 22 | | in writing when the recreational water safety video is available |
|---|
| 23 | 23 | | for the agency's use. |
|---|
| 24 | 24 | | (c) The department may edit the content of the recreational |
|---|
| 25 | 25 | | water safety video to produce a boater education video that |
|---|
| 26 | 26 | | complies with federal standards for boating education courses |
|---|
| 27 | 27 | | published by the National Association of State Boating Law |
|---|
| 28 | 28 | | Administrators. |

| 29 | 29 | | SECTION 2. Subchapter Z, Chapter 29, Education Code, is |
|---|
| 30 | 30 | | amended by adding Section 29.9021 to read as follows: |
|---|
| 31 | 31 | | Sec. 29.9021. WATER SAFETY EDUCATION. The agency by rule |
|---|
| 32 | 32 | | shall incorporate a curriculum module on recreational water safety |
|---|
| 33 | 33 | | into driver education instruction using the video on recreational |
|---|
| 34 | 34 | | water safety produced under Section 12.012, Parks and Wildlife |
|---|
| 35 | 35 | | Code, when the agency is notified that the video is available. |
|---|
| 36 | 36 | | SECTION 3. The Parks and Wildlife Department shall produce |
|---|
| 37 | 37 | | the recreational water safety video described by Section 12.012, |
|---|
| 38 | 38 | | Parks and Wildlife Code, as added by this Act, as soon as production |
|---|
| 39 | 39 | | costs can be paid from money identified as available for that |
|---|
| 40 | 40 | | purpose in the department's operating budget. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2011. |
