99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the production and use of an instructional video on
1212 recreational water safety.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter A, Chapter 12, Parks and Wildlife
1515 Code, is amended by adding Section 12.012 to read as follows:
1616 Sec. 12.012. RECREATIONAL WATER SAFETY VIDEO. (a) The
1717 department shall produce a video suitable for use with high school
1818 students on recreational water safety. The video must include
1919 instruction on safe participation in recreational activities in,
2020 on, or around the lakes, rivers, and coastal waters of this state.
2121 (b) The department shall notify the Texas Education Agency
2222 in writing when the recreational water safety video is available
2323 for the agency's use.
2424 (c) The department may edit the content of the recreational
2525 water safety video to produce a boater education video that
2626 complies with federal standards for boating education courses
2727 published by the National Association of State Boating Law
2828 Administrators.
2929 SECTION 2. Subchapter Z, Chapter 29, Education Code, is
3030 amended by adding Section 29.9021 to read as follows:
3131 Sec. 29.9021. WATER SAFETY EDUCATION. The agency by rule
3232 shall incorporate a curriculum module on recreational water safety
3333 into driver education instruction using the video on recreational
3434 water safety produced under Section 12.012, Parks and Wildlife
3535 Code, when the agency is notified that the video is available.
3636 SECTION 3. The Parks and Wildlife Department shall produce
3737 the recreational water safety video described by Section 12.012,
3838 Parks and Wildlife Code, as added by this Act, as soon as production
3939 costs can be paid from money identified as available for that
4040 purpose in the department's operating budget.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2011.
