| 11 | 11 | | relating to the validation of certain governmental acts and |
|---|
| 12 | 12 | | proceedings of certain municipalities relating to certain public |
|---|
| 13 | 13 | | improvement districts. |
|---|
| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. This Act applies only to a municipality with a |
|---|
| 16 | 16 | | population of 500 or less according to the 2000 federal census. |
|---|
| 17 | 17 | | SECTION 2. (a) All governmental acts and proceedings of a |
|---|
| 18 | 18 | | governing body of a municipality under Subchapter A, Chapter 372, |
|---|
| 19 | 19 | | Local Government Code, taken or occurring before the effective date |
|---|
| 20 | 20 | | of this Act, to establish a public improvement district, designate |
|---|
| 21 | 21 | | improvements, levy assessments, or finance costs of improvements, |
|---|
| 22 | 22 | | are validated. |
|---|
| 23 | 23 | | (b) This section does not apply to: |
|---|
| 24 | 24 | | (1) an act or proceeding the validity of which is the |
|---|
| 25 | 25 | | subject of litigation that is pending on the effective date of this |
|---|
| 26 | 26 | | Act; or |
|---|
| 27 | 27 | | (2) a governmental act or proceeding that, under the |
|---|
| 28 | 28 | | law of this state at the time the act or proceeding occurred, was a |
|---|
| 29 | 29 | | misdemeanor or a felony. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2011. |
