1010 AN ACT
1111 relating to the creation of the Harris County Municipal Utility
1212 District No. 524; providing authority to impose a tax and issue
1313 bonds; granting a limited power of eminent domain.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1616 Code, is amended by adding Chapter 8354 to read as follows:
1717 CHAPTER 8354. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 524
1818 SUBCHAPTER A. GENERAL PROVISIONS
1919 Sec. 8354.001. DEFINITIONS. In this chapter:
2020 (1) "Board" means the district's board of directors.
2121 (2) "Commission" means the Texas Commission on
2222 Environmental Quality.
2323 (3) "Director" means a board member.
2424 (4) "District" means the Harris County Municipal
2525 Utility District No. 524.
2626 Sec. 8354.002. NATURE OF DISTRICT. The district is a
2727 municipal utility district created under Section 59, Article XVI,
2828 Texas Constitution.
2929 Sec. 8354.003. CONFIRMATION AND DIRECTORS' ELECTION
3030 REQUIRED. The temporary directors shall hold an election to
3131 confirm the creation of the district and to elect five permanent
3232 directors as provided by Section 49.102, Water Code.
3333 Sec. 8354.004. CONSENT OF MUNICIPALITY REQUIRED. The
3434 temporary directors may not hold an election under Section 8354.003
3535 until each municipality in whose corporate limits or
3636 extraterritorial jurisdiction the district is located has
3737 consented by ordinance or resolution to the creation of the
3838 district and to the inclusion of land in the district.
3939 Sec. 8354.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4040 The district is created to serve a public purpose and benefit.
4141 (b) The district is created to accomplish the purposes of:
4242 (1) a municipal utility district as provided by
4343 general law and Section 59, Article XVI, Texas Constitution; and
4444 (2) Section 52, Article III, Texas Constitution, that
4545 relate to the construction, acquisition, or improvement of
4646 macadamized, graveled, or paved roads described by Section 54.234,
4747 Water Code, or improvements, including storm drainage, in aid of
4848 those roads.
4949 Sec. 8354.006. INITIAL DISTRICT TERRITORY. (a) The
5050 district is initially composed of the territory described by
5151 Section 2 of the Act enacting this chapter.
5252 (b) The boundaries and field notes contained in Section 2 of
5353 the Act enacting this chapter form a closure. A mistake made in the
5454 field notes or in copying the field notes in the legislative process
5555 does not affect the district's:
5656 (1) organization, existence, or validity;
5757 (2) right to issue any type of bond for the purposes
5858 for which the district is created or to pay the principal of and
5959 interest on a bond;
6060 (3) right to impose a tax; or
6161 (4) legality or operation.

6363 SUBCHAPTER B. BOARD OF DIRECTORS
6464 Sec. 8354.051. GOVERNING BODY; TERMS. (a) The district is
6565 governed by a board of five elected directors.
6666 (b) Except as provided by Section 8354.052, directors serve
6767 staggered four-year terms.
6868 Sec. 8354.052. TEMPORARY DIRECTORS. (a) On or after the
6969 effective date of the Act enacting this chapter, the owner or owners
7070 of a majority of the assessed value of the real property in the
7171 district may submit a petition to the commission requesting that
7272 the commission appoint as temporary directors the five persons
7373 named in the petition. The commission shall appoint as temporary
7474 directors the five persons named in the petition.
7575 (b) Temporary directors serve until the earlier of:
7676 (1) the date permanent directors are elected under
7777 Section 8354.003; or
7878 (2) the fourth anniversary of the effective date of
7979 the Act enacting this chapter.
8080 (c) If permanent directors have not been elected under
8181 Section 8354.003 and the terms of the temporary directors have
8282 expired, successor temporary directors shall be appointed or
8383 reappointed as provided by Subsection (d) to serve terms that
8484 expire on the earlier of:
8585 (1) the date permanent directors are elected under
8686 Section 8354.003; or
8787 (2) the fourth anniversary of the date of the
8888 appointment or reappointment.
8989 (d) If Subsection (c) applies, the owner or owners of a
9090 majority of the assessed value of the real property in the district
9191 may submit a petition to the commission requesting that the
9292 commission appoint as successor temporary directors the five
9393 persons named in the petition. The commission shall appoint as
9494 successor temporary directors the five persons named in the
9595 petition.

9797 SUBCHAPTER C. POWERS AND DUTIES
9898 Sec. 8354.101. GENERAL POWERS AND DUTIES. The district has
9999 the powers and duties necessary to accomplish the purposes for
100100 which the district is created.
101101 Sec. 8354.102. MUNICIPAL UTILITY DISTRICT POWERS AND
102102 DUTIES. The district has the powers and duties provided by the
103103 general law of this state, including Chapters 49 and 54, Water Code,
104104 applicable to municipal utility districts created under Section 59,
105105 Article XVI, Texas Constitution.
106106 Sec. 8354.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
107107 Section 52, Article III, Texas Constitution, the district may
108108 design, acquire, construct, finance, issue bonds for, improve, and
109109 convey to this state, a county, or a municipality for operation and
110110 maintenance macadamized, graveled, or paved roads described by
111111 Section 54.234, Water Code, or improvements, including storm
112112 drainage, in aid of those roads.
113113 (b) The district may exercise the powers provided by this
114114 section without submitting a petition to or obtaining approval from
115115 the commission as required by Section 54.234, Water Code.
116116 Sec. 8354.104. APPROVAL OF ROAD PROJECT. (a) The district
117117 may not undertake a road project authorized by Section 8354.103
118118 unless:
119119 (1) each municipality or county that will operate and
120120 maintain the road has approved the plans and specifications of the
121121 road project, if a municipality or county will operate and maintain
122122 the road; or
123123 (2) the Texas Transportation Commission has approved
124124 the plans and specifications of the road project, if the state will
125125 operate and maintain the road.
126126 (b) Except as provided by Subsection (a), the district is
127127 not required to obtain approval from the Texas Transportation
128128 Commission to design, acquire, construct, finance, issue bonds for,
129129 improve, or convey a road project.
130130 Sec. 8354.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
131131 OR RESOLUTION. The district shall comply with all applicable
132132 requirements of any ordinance or resolution that is adopted under
133133 Section 54.016 or 54.0165, Water Code, and that consents to the
134134 creation of the district or to the inclusion of land in the
135135 district.
136136 Sec. 8354.106. LIMITATION ON USE OF EMINENT DOMAIN. The
137137 district may not exercise the power of eminent domain outside the
138138 district to acquire a site or easement for:
139139 (1) a road project authorized by Section 8354.103; or
140140 (2) a recreational facility as defined by Section
141141 49.462, Water Code.

143143 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
144144 Sec. 8354.151. DIVISION OF DISTRICT; PREREQUISITES. The
145145 district may be divided into two or more new districts only if the
146146 district:
147147 (1) has no outstanding bonded debt; and
148148 (2) is not imposing ad valorem taxes.
149149 Sec. 8354.152. LAW APPLICABLE TO NEW DISTRICT. This
150150 chapter applies to any new district created by division of the
151151 district, and a new district has all the powers and duties of the
152152 district.
153153 Sec. 8354.153. LIMITATION ON AREA OF NEW DISTRICT. A new
154154 district created by the division of the district may not, at the
155155 time the new district is created, contain any land outside the area
156156 described by Section 2 of the Act enacting this chapter.
157157 Sec. 8354.154. DIVISION PROCEDURES. (a) The board, on its
158158 own motion or on receipt of a petition signed by the owner or owners
159159 of a majority of the assessed value of the real property in the
160160 district, may adopt an order dividing the district.
161161 (b) The board may adopt an order dividing the district
162162 before or after the date the board holds an election under Section
163163 8354.003 to confirm the district's creation.
164164 (c) An order dividing the district:
165165 (1) must:
166166 (A) name each new district;
167167 (B) include the metes and bounds description of
168168 the territory of each new district;
169169 (C) appoint temporary directors for each new
170170 district, or provide that temporary directors are appointed in the
171171 manner provided by Section 8354.052(a); and
172172 (D) provide for the division of assets and
173173 liabilities between the new districts; and
174174 (2) is subject to a confirmation election in each new
175175 district.
176176 (d) On or before the 30th day after the date of adoption of
177177 an order dividing the district, the district shall file the order
178178 with the commission and record the order in the real property
179179 records of each county in which the district is located.
180180 Sec. 8354.155. CONFIRMATION ELECTION FOR NEW DISTRICT. (a)
181181 A new district created by the division of the district shall hold a
182182 confirmation and directors' election as required by Section
183183 8354.003.
184184 (b) The results of that election must be filed as required
185185 by Sections 49.102(e) and (f), Water Code.
186186 (c) If the voters of a new district do not confirm the
187187 creation of the new district, the assets, liabilities, territory,
188188 and governance of the new districts revert to the original
189189 district.
190190 Sec. 8354.156. MUNICIPAL CONSENT. Municipal consent to the
191191 creation of the district and to the inclusion of land in the
192192 district granted under Section 8354.004 acts as municipal consent
193193 to the creation of any new district created by the division of the
194194 district and to the inclusion of land in the new district.
195195 Sec. 8354.157. TAX OR BOND ELECTION. Before a new district
196196 created by the division of the district may impose a maintenance tax
197197 or issue bonds payable wholly or partly from ad valorem taxes, the
198198 new district must hold an election as required by this chapter to
199199 obtain voter approval.

201201 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
202202 Sec. 8354.201. ELECTIONS REGARDING TAXES OR BONDS. (a) The
203203 district may issue, without an election, bonds and other
204204 obligations secured by:
205205 (1) revenue other than ad valorem taxes; or
206206 (2) contract payments described by Section 8354.203.
207207 (b) The district must hold an election in the manner
208208 provided by Chapters 49 and 54, Water Code, to obtain voter approval
209209 before the district may impose an ad valorem tax or issue bonds
210210 payable from ad valorem taxes.
211211 (c) The district may not issue bonds payable from ad valorem
212212 taxes to finance a road project unless the issuance is approved by a
213213 vote of a two-thirds majority of the district voters voting at an
214214 election held for that purpose.
215215 Sec. 8354.202. OPERATION AND MAINTENANCE TAX. (a) If
216216 authorized at an election held under Section 8354.201, the district
217217 may impose an operation and maintenance tax on taxable property in
218218 the district in accordance with Section 49.107, Water Code.
219219 (b) The board shall determine the tax rate. The rate may not
220220 exceed the rate approved at the election.
221221 Sec. 8354.203. CONTRACT TAXES. (a) In accordance with
222222 Section 49.108, Water Code, the district may impose a tax other than
223223 an operation and maintenance tax and use the revenue derived from
224224 the tax to make payments under a contract after the provisions of
225225 the contract have been approved by a majority of the district voters
226226 voting at an election held for that purpose.
227227 (b) A contract approved by the district voters may contain a
228228 provision stating that the contract may be modified or amended by
229229 the board without further voter approval.

231231 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
232232 Sec. 8354.251. AUTHORITY TO ISSUE BONDS AND OTHER
233233 OBLIGATIONS. The district may issue bonds or other obligations
234234 payable wholly or partly from ad valorem taxes, impact fees,
235235 revenue, contract payments, grants, or other district money, or any
236236 combination of those sources, to pay for any authorized district
237237 purpose.
238238 Sec. 8354.252. TAXES FOR BONDS. At the time the district
239239 issues bonds payable wholly or partly from ad valorem taxes, the
240240 board shall provide for the annual imposition of a continuing
241241 direct ad valorem tax, without limit as to rate or amount, while all
242242 or part of the bonds are outstanding as required and in the manner
243243 provided by Sections 54.601 and 54.602, Water Code.
244244 Sec. 8354.253. BONDS FOR ROAD PROJECTS. At the time of
245245 issuance, the total principal amount of bonds or other obligations
246246 issued or incurred to finance road projects and payable from ad
247247 valorem taxes may not exceed one-fourth of the assessed value of the
248248 real property in the district.
249249 SECTION 2. The Harris County Municipal Utility District No.
250250 524 initially includes all the territory contained in the following
251251 area: 990.804 acres in 5 non-contiguous tracts out of Sections 9,
252252 10, 15, and 16 of Harris County School Land Survey, Abstract No 332,
253253 recorded in Vol 17, Pg 222 of the Deed Records of Harris County,
254254 Texas and including within Tracts 1, 2, 3, and 4 an unnamed 66 foot
255255 roadway as shown on the plat of said Harris County School Land being
256256 granted by Commissioners Award recorded in Vol 7448, Pg 181, HCDR;
257257 said roadway does not exist physically on the ground: (All bearings
258258 used herein are based on Highway Right-of-Way Maps provided by the
259259 Texas Department of Transportation)
260260 Tract 1
261261 A tract or parcel of land containing 255.572 acres (11,132,730
262262 square feet) out of Lots 9, 10, 15, and 16 of Section 9 and Lots 1,
263263 2, 7, & 8 of Section 16 of said Harris County School Land Survey,
264264 Abstract No 332, Harris County, Texas; said 255.572 acres being
265265 that same tract of land called 257.230 acres described by deed
266266 recorded in HCCF No M577056 ("Tract 1", therein) and conveyed to
267267 Delta Troy Interests, Ltd by deed recorded in X381657 and more
268268 particularly described by metes and bounds as follows:
269269 COMMENCING at a State Department of Highways and Public
270270 Transportation Horizontal Control Monument located in the
271271 southerly right-of-way line of U.S. 290, 160.00 feet at right
272272 angles from the centerline, across from Engineers Station
273273 109+27.74;
274274 THENCE along said southerly right-of-way line, clockwise,
275275 following the arc of a 1855.86 foot radius curve-to-the-right,
276276 subtending a central angle of 03 degrees 20 min 18 seconds, through
277277 an arc length of 108.13 feet (chord bearing of South 66 degrees 23
278278 minutes 38 seconds East, 108.12 feet) to a 5/8 inch iron rod found

696696 (b) The governor, one of the required recipients, has
697697 submitted the notice and Act to the Texas Commission on
698698 Environmental Quality.
699699 (c) The Texas Commission on Environmental Quality has filed
700700 its recommendations relating to this Act with the governor, the
701701 lieutenant governor, and the speaker of the house of
702702 representatives within the required time.
703703 (d) All requirements of the constitution and laws of this
704704 state and the rules and procedures of the legislature with respect
705705 to the notice, introduction, and passage of this Act are fulfilled
706706 and accomplished.
707707 SECTION 4. (a) Section 8354.106, Special District Local
708708 Laws Code, as added by Section 1 of this Act, takes effect only if
709709 this Act receives a two-thirds vote of all the members elected to
710710 each house.
711711 (b) If this Act does not receive a two-thirds vote of all the
712712 members elected to each house, Subchapter C, Chapter 8354, Special
713713 District Local Laws Code, as added by Section 1 of this Act, is
714714 amended by adding Section 8354.106 to read as follows:
715715 Sec. 8354.106. NO EMINENT DOMAIN POWER. The district may
716716 not exercise the power of eminent domain.
717717 (c) This section is not intended to be an expression of a
718718 legislative interpretation of the requirements of Section 17(c),
719719 Article I, Texas Constitution.
720720 SECTION 5. Except as provided by Section 4 of this Act:
721721 (1) this Act takes effect immediately if it receives a
722722 vote of two-thirds of all the members elected to each house, as
723723 provided by Section 39, Article III, Texas Constitution; and
724724 (2) if this Act does not receive the vote necessary for
725725 immediate effect, this Act takes effect September 1, 2011.
