1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the East Montgomery County Improvement District.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 3846.001(3), Special District Local Laws
1515 Code, is amended to read as follows:
1616 (3) "Venue" means:
1717 (A) an arena, coliseum, stadium, or other type of
1818 area or facility:
1919 (i) that is used or is planned for use for
2020 one or more professional or amateur sports events, community
2121 events, or other sports events, including rodeos, livestock shows,
2222 agricultural expositions, promotional events, and other civic or
2323 charitable events; and
2424 (ii) for which a fee for admission to the
2525 events is charged or is planned to be charged; or
2626 (B) a convention center facility or related
2727 improvement such as a convention center, civic center, civic center
2828 building, civic center hotel, auditorium, theater, opera house,
2929 music hall, exhibition hall, rehearsal hall, park, zoological park,
3030 museum, aquarium, tourist development area along an inland
3131 waterway, or plaza.
3232 SECTION 2. Section 3846.155(c), Special District Local Laws
3333 Code, is repealed.
3434 SECTION 3. (a) The legal notice of the intention to
3535 introduce this Act, setting forth the general substance of this
3636 Act, has been published as provided by law, and the notice and a
3737 copy of this Act have been furnished to all persons, agencies,
3838 officials, or entities to which they are required to be furnished
3939 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4040 Government Code.
4141 (b) The governor, one of the required recipients, has
4242 submitted the notice and Act to the Texas Commission on
4343 Environmental Quality.
4444 (c) The Texas Commission on Environmental Quality has filed
4545 its recommendations relating to this Act with the governor,
4646 lieutenant governor, and speaker of the house of representatives
4747 within the required time.
4848 (d) The general law relating to consent by political
4949 subdivisions to the creation of districts with conservation,
5050 reclamation, and road powers and the inclusion of land in those
5151 districts has been complied with.
5252 (e) All requirements of the constitution and laws of this
5353 state and the rules and procedures of the legislature with respect
5454 to the notice, introduction, and passage of this Act have been
5555 fulfilled and accomplished.
5656 SECTION 4. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2011.
