12 | 12 | | relating to the East Montgomery County Improvement District. |

13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Section 3846.001(3), Special District Local Laws |
---|
15 | 15 | | Code, is amended to read as follows: |
---|
16 | 16 | | (3) "Venue" means: |
---|
17 | 17 | | (A) an arena, coliseum, stadium, or other type of |
---|
18 | 18 | | area or facility: |
---|
19 | 19 | | (i) that is used or is planned for use for |
---|
20 | 20 | | one or more professional or amateur sports events, community |
---|
21 | 21 | | events, or other sports events, including rodeos, livestock shows, |
---|
22 | 22 | | agricultural expositions, promotional events, and other civic or |
---|
23 | 23 | | charitable events; and |
---|
24 | 24 | | (ii) for which a fee for admission to the |
---|
25 | 25 | | events is charged or is planned to be charged; or |
---|
26 | 26 | | (B) a convention center facility or related |
---|
27 | 27 | | improvement such as a convention center, civic center, civic center |
---|
28 | 28 | | building, civic center hotel, auditorium, theater, opera house, |
---|
29 | 29 | | music hall, exhibition hall, rehearsal hall, park, zoological park, |
---|
30 | 30 | | museum, aquarium, tourist development area along an inland |
---|
31 | 31 | | waterway, or plaza. |
---|
32 | 32 | | SECTION 2. Section 3846.155(c), Special District Local Laws |
---|
33 | 33 | | Code, is repealed. |
---|
34 | 34 | | SECTION 3. (a) The legal notice of the intention to |
---|
35 | 35 | | introduce this Act, setting forth the general substance of this |
---|
36 | 36 | | Act, has been published as provided by law, and the notice and a |
---|
37 | 37 | | copy of this Act have been furnished to all persons, agencies, |
---|
38 | 38 | | officials, or entities to which they are required to be furnished |
---|
39 | 39 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
40 | 40 | | Government Code. |
---|
41 | 41 | | (b) The governor, one of the required recipients, has |
---|
42 | 42 | | submitted the notice and Act to the Texas Commission on |
---|
43 | 43 | | Environmental Quality. |
---|
44 | 44 | | (c) The Texas Commission on Environmental Quality has filed |
---|
45 | 45 | | its recommendations relating to this Act with the governor, |
---|
46 | 46 | | lieutenant governor, and speaker of the house of representatives |
---|
47 | 47 | | within the required time. |
---|
48 | 48 | | (d) The general law relating to consent by political |
---|
49 | 49 | | subdivisions to the creation of districts with conservation, |
---|
50 | 50 | | reclamation, and road powers and the inclusion of land in those |
---|
51 | 51 | | districts has been complied with. |
---|
52 | 52 | | (e) All requirements of the constitution and laws of this |
---|
53 | 53 | | state and the rules and procedures of the legislature with respect |
---|
54 | 54 | | to the notice, introduction, and passage of this Act have been |
---|
55 | 55 | | fulfilled and accomplished. |
---|
56 | 56 | | SECTION 4. This Act takes effect immediately if it receives |
---|
57 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
58 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
59 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
60 | 60 | | Act takes effect September 1, 2011. |
