8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 38.10, Penal Code, is amended by | |
10 | 10 | amending Subsection (d) and adding Subsection (g) to read as | |
11 | 11 | follows: | |
12 | 12 | (d) Except as otherwise provided by this section [in | |
13 | 13 | Subsections (e) and (f)], an offense under this section is a Class A | |
14 | 14 | misdemeanor. | |
15 | 15 | (g) An offense under this section is a felony of the first | |
16 | 16 | degree if the offense for which the actor's appearance was required | |
17 | 17 | is an offense under Section 19.02 (murder) or 19.03 (capital | |
18 | 18 | murder). | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to an offense committed on or after the effective date of this Act. | |
21 | 21 | An offense committed before the effective date of this Act is | |
22 | 22 | covered by the law in effect when the offense was committed, and the | |
23 | 23 | former law is continued in effect for that purpose. For purposes of | |
24 | 24 | this section, an offense was committed before the effective date of | |
25 | 25 | this Act if any element of the offense was committed before that | |
26 | 26 | date. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2011. |
