88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 38.10, Penal Code, is amended by
1010 amending Subsection (d) and adding Subsection (g) to read as
1111 follows:
1212 (d) Except as otherwise provided by this section [in
1313 Subsections (e) and (f)], an offense under this section is a Class A
1414 misdemeanor.
1515 (g) An offense under this section is a felony of the first
1616 degree if the offense for which the actor's appearance was required
1717 is an offense under Section 19.02 (murder) or 19.03 (capital
1818 murder).
1919 SECTION 2. The change in law made by this Act applies only
2020 to an offense committed on or after the effective date of this Act.
2121 An offense committed before the effective date of this Act is
2222 covered by the law in effect when the offense was committed, and the
2323 former law is continued in effect for that purpose. For purposes of
2424 this section, an offense was committed before the effective date of
2525 this Act if any element of the offense was committed before that
2626 date.
2727 SECTION 3. This Act takes effect September 1, 2011.
