7	7	relating to registration with the Selective Service System of
8	8	certain applicants for a driver's license or personal
9	9	identification certificate.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 521.147, Transportation Code, is amended
12	12	to read as follows:
13	13	Sec. 521.147. [OPTIONAL] REGISTRATION WITH SELECTIVE
14	14	SERVICE SYSTEM. (a) After an application for an original, renewal,
15	15	or duplicate driver's license or personal identification
16	16	certificate is submitted by a male applicant who on the date of the
17	17	application is at least 18 years of age but younger than 26 years of
18	18	age, the department shall send in an electronic format to the United
19	19	States Selective Service System the information from the
20	20	application necessary to register the applicant under the Military
21	21	Selective Service Act (50 U.S.C. App. Section 451 et seq.).
22	22	(b) An application under this section must give written
23	23	notice to an applicant that the application also constitutes
24	24	registration with the United States Selective Service System for
25	25	persons who are subject to registration and have not previously
26	26	registered. The notice must be conspicuous on the application and
27	27	state: "By submitting this application, I am consenting to
28	28	registration with the United States Selective Service System if my
29	29	registration is required by federal law."
30	30	(c) The applicant's submission of the application following
31	31	this notification constitutes the applicant's consent to the
32	32	sending of the information and the [The department shall develop by
33	33	rule a selective service consent statement as a part of the
34	34	application for an original, renewal, or duplicate driver's license
35	35	or personal identification certificate. The consent statement must
36	36	include a place to indicate consent or declination to register with
37	37	the United States Selective Service System and must state the
38	38	benefits and penalties associated with consent or declination to
39	39	register. The department shall present the statement to each
40	40	applicant who is subject to registration with the Selective Service
41	41	System and record the applicant's response. A response is required
42	42	to complete the application for a license or certificate for such an
43	43	applicant. The department shall forward to the Selective Service
44	44	System, in an electronic format, only the information necessary for
45	45	registration of an applicant consenting to] registration.
46	46	(d) [(b)] In addition to the notification [statement]
47	47	required by Subsection (b) [(a)], the department may conspicuously
48	48	post at each location where applications for driver's licenses and
49	49	personal identification certificates are accepted one or more
50	50	signs, in English and Spanish, providing the information contained
51	51	in the notification [statement].
52	52	(e) Subsections (a) and (c) do not apply to an applicant
53	53	concerning whom the department has previously sent information to
54	54	the Selective Service System.
55	55	SECTION 2. This Act applies only to an application for the
56	56	issuance of a driver's license or personal identification
57	57	certificate submitted on or after the effective date of this Act.
58	58	SECTION 3. This Act takes effect September 1, 2011.
