66 AN ACT
77 relating to the definition of peace officer for purposes of
88 intercepting or collecting information in relation to certain
99 communications in an investigation of criminal conduct.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1(2), Article 18.21, Code of Criminal
1212 Procedure, is amended to read as follows:
1313 (2) "Authorized peace officer" means:
1414 (A) a sheriff or a sheriff's deputy;
1515 (B) a constable or deputy constable;
1616 (C) a marshal or police officer of an
1717 incorporated city;
1818 (D) a ranger or officer commissioned by the
1919 Public Safety Commission or the director of the Department of
2020 Public Safety;
2121 (E) an investigator of a prosecutor's office;
2222 (F) a law enforcement agent of the Alcoholic
2323 Beverage Commission;
2424 (G) a law enforcement officer commissioned by the
2525 Parks and Wildlife Commission; [or]
2626 (H) an enforcement officer appointed by the
2727 executive director of the Texas Department of Criminal Justice
2828 under Section 493.019, Government Code; or
2929 (I) a fire marshal or related officer, inspector,
3030 or investigator commissioned by a county under Subchapter B,
3131 Chapter 352, Local Government Code.
3232 SECTION 2. This Act takes effect September 1, 2011.
