1010 relating to the creation of the Harris County Municipal Utility
1111 District No. 528; providing authority to impose a tax and issue
1212 bonds; granting a limited power of eminent domain.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 8318 to read as follows:
1616 CHAPTER 8318. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 528
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8318.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the district's board of directors.
2020 (2) "Commission" means the Texas Commission on
2121 Environmental Quality.
2222 (3) "Director" means a board member.
2323 (4) "District" means the Harris County Municipal
2424 Utility District No. 528.
2525 Sec. 8318.002. NATURE OF DISTRICT. The district is a
2626 municipal utility district created under Section 59, Article XVI,
2727 Texas Constitution.
2828 Sec. 8318.003. CONFIRMATION AND DIRECTORS' ELECTION
2929 REQUIRED. The temporary directors shall hold an election to
3030 confirm the creation of the district and to elect five permanent
3131 directors as provided by Section 49.102, Water Code.
3232 Sec. 8318.004. CONSENT OF MUNICIPALITY REQUIRED. The
3333 temporary directors may not hold an election under Section 8318.003
3434 until each municipality in whose corporate limits or
3535 extraterritorial jurisdiction the district is located has
3636 consented by ordinance or resolution to the creation of the
3737 district and to the inclusion of land in the district.
3838 Sec. 8318.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3939 (a) The district is created to serve a public purpose and benefit.
4040 (b) The district is created to accomplish the purposes of:
4141 (1) a municipal utility district as provided by
4242 general law and Section 59, Article XVI, Texas Constitution; and
4343 (2) Section 52, Article III, Texas Constitution, that
4444 relate to the construction, acquisition, improvement, operation,
4545 or maintenance of macadamized, graveled, or paved roads, or
4646 improvements, including storm drainage, in aid of those roads.
4747 Sec. 8318.006. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act enacting this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act enacting this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.

6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8318.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8318.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8318.052. TEMPORARY DIRECTORS. (a) On or after
6767 September 1, 2011, the owner or owners of a majority of the assessed
6868 value of the real property in the district may submit a petition to
6969 the commission requesting that the commission appoint as temporary
7070 directors the five persons named in the petition. The commission
7171 shall appoint as temporary directors the five persons named in the
7272 petition.
7373 (b) Temporary directors serve until the earlier of:
7474 (1) the date permanent directors are elected under
7575 Section 8318.003; or
7676 (2) September 1, 2015.
7777 (c) If permanent directors have not been elected under
7878 Section 8318.003 and the terms of the temporary directors have
7979 expired, successor temporary directors shall be appointed or
8080 reappointed as provided by Subsection (d) to serve terms that
8181 expire on the earlier of:
8282 (1) the date permanent directors are elected under
8383 Section 8318.003; or
8484 (2) the fourth anniversary of the date of the
8585 appointment or reappointment.
8686 (d) If Subsection (c) applies, the owner or owners of a
8787 majority of the assessed value of the real property in the district
8888 may submit a petition to the commission requesting that the
8989 commission appoint as successor temporary directors the five
9090 persons named in the petition. The commission shall appoint as
9191 successor temporary directors the five persons named in the
9292 petition.

9494 SUBCHAPTER C. POWERS AND DUTIES
9595 Sec. 8318.101. GENERAL POWERS AND DUTIES. The district has
9696 the powers and duties necessary to accomplish the purposes for
9797 which the district is created.
9898 Sec. 8318.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9999 DUTIES. The district has the powers and duties provided by the
100100 general law of this state, including Chapters 49 and 54, Water Code,
101101 applicable to municipal utility districts created under Section 59,
102102 Article XVI, Texas Constitution.
103103 Sec. 8318.103. AUTHORITY FOR ROAD PROJECTS. Under Section
104104 52, Article III, Texas Constitution, the district may design,
105105 acquire, construct, finance, issue bonds for, improve, operate,
106106 maintain, and convey to this state, a county, or a municipality for
107107 operation and maintenance macadamized, graveled, or paved roads, or
108108 improvements, including storm drainage, in aid of those roads.
109109 Sec. 8318.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
110110 road project must meet all applicable construction standards,
111111 zoning and subdivision requirements, and regulations of each
112112 municipality in whose corporate limits or extraterritorial
113113 jurisdiction the road project is located.
114114 (b) If a road project is not located in the corporate limits
115115 or extraterritorial jurisdiction of a municipality, the road
116116 project must meet all applicable construction standards,
117117 subdivision requirements, and regulations of each county in which
118118 the road project is located.
119119 (c) If the state will maintain and operate the road, the
120120 Texas Transportation Commission must approve the plans and
121121 specifications of the road project.
122122 Sec. 8318.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
123123 OR RESOLUTION. The district shall comply with all applicable
124124 requirements of any ordinance or resolution adopted by the city
125125 council of the City of Baytown.
126126 Sec. 8318.106. LIMITATION ON USE OF EMINENT DOMAIN. The
127127 district may not exercise the power of eminent domain outside the
128128 district to acquire a site or easement for:
129129 (1) a road project authorized by Section 8318.103; or
130130 (2) a recreational facility as defined by Section
131131 49.462, Water Code.

133133 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
134134 Sec. 8318.151. ELECTIONS REGARDING TAXES OR BONDS.
135135 (a) The district may issue, without an election, bonds and other
136136 obligations secured by:
137137 (1) revenue other than ad valorem taxes; or
138138 (2) contract payments described by Section 8318.153.
139139 (b) The district must hold an election in the manner
140140 provided by Chapters 49 and 54, Water Code, to obtain voter approval
141141 before the district may impose an ad valorem tax or issue bonds
142142 payable from ad valorem taxes.
143143 (c) The district may not issue bonds payable from ad valorem
144144 taxes to finance a road project unless the issuance is approved by a
145145 vote of a two-thirds majority of the district voters voting at an
146146 election held for that purpose.
147147 Sec. 8318.152. OPERATION AND MAINTENANCE TAX. (a) If
148148 authorized at an election held under Section 8318.151, the district
149149 may impose an operation and maintenance tax on taxable property in
150150 the district in accordance with Section 49.107, Water Code.
151151 (b) The board shall determine the tax rate. The rate may not
152152 exceed the rate approved at the election.
153153 Sec. 8318.153. CONTRACT TAXES. (a) In accordance with
154154 Section 49.108, Water Code, the district may impose a tax other than
155155 an operation and maintenance tax and use the revenue derived from
156156 the tax to make payments under a contract after the provisions of
157157 the contract have been approved by a majority of the district voters
158158 voting at an election held for that purpose.
159159 (b) A contract approved by the district voters may contain a
160160 provision stating that the contract may be modified or amended by
161161 the board without further voter approval.

163163 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
164164 Sec. 8318.201. AUTHORITY TO ISSUE BONDS AND OTHER
165165 OBLIGATIONS. The district may issue bonds or other obligations
166166 payable wholly or partly from ad valorem taxes, impact fees,
167167 revenue, contract payments, grants, or other district money, or any
168168 combination of those sources, to pay for any authorized district
169169 purpose.
170170 Sec. 8318.202. TAXES FOR BONDS. At the time the district
171171 issues bonds payable wholly or partly from ad valorem taxes, the
172172 board shall provide for the annual imposition of a continuing
173173 direct ad valorem tax, without limit as to rate or amount, while all
174174 or part of the bonds are outstanding as required and in the manner
175175 provided by Sections 54.601 and 54.602, Water Code.
176176 Sec. 8318.203. BONDS FOR ROAD PROJECTS. At the time of
177177 issuance, the total principal amount of bonds or other obligations
178178 issued or incurred to finance road projects and payable from ad
179179 valorem taxes may not exceed one-fourth of the assessed value of the
180180 real property in the district.
181181 SECTION 2. The Harris County Municipal Utility District No.
182182 528 initially includes all the territory contained in the following
183183 area:
184184 TRACT 1
185185 FIELD NOTES of a 27.8347 acre tract of land situated in the William
186186 Scott Lower league, Abstract No. 65, Harris County, Texas, and
187187 being out of and a part of a 1541 acre tract of land conveyed to
188188 Ashbel Smith Land Company by B. W. Armstrong, et al, by Deed dated
189189 November 29, 1935, and recorded in Volume 996 at Page 379 of the
190190 Deed Records of Harris County, Texas. This 27.8347 acre tract of
191191 land is more particularly described by metes and bounds as follows,
192192 to-wit:

434434 SECTION 3. (a) The legal notice of the intention to
435435 introduce this Act, setting forth the general substance of this
436436 Act, has been published as provided by law, and the notice and a
437437 copy of this Act have been furnished to all persons, agencies,
438438 officials, or entities to which they are required to be furnished
439439 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
440440 Government Code.
441441 (b) The governor, one of the required recipients, has
442442 submitted the notice and Act to the Texas Commission on
443443 Environmental Quality.
444444 (c) The Texas Commission on Environmental Quality has filed
445445 its recommendations relating to this Act with the governor, the
446446 lieutenant governor, and the speaker of the house of
447447 representatives within the required time.
448448 (d) All requirements of the constitution and laws of this
449449 state and the rules and procedures of the legislature with respect
450450 to the notice, introduction, and passage of this Act are fulfilled
451451 and accomplished.
452452 SECTION 4. (a) Section 8318.106, Special District Local
453453 Laws Code, as added by Section 1 of this Act, takes effect only if
454454 this Act receives a two-thirds vote of all the members elected to
455455 each house.
456456 (b) If this Act does not receive a two-thirds vote of all the
457457 members elected to each house, Subchapter C, Chapter 8318, Special
458458 District Local Laws Code, as added by Section 1 of this Act, is
459459 amended by adding Section 8318.106 to read as follows:
460460 Sec. 8318.106. NO EMINENT DOMAIN POWER. The district may
461461 not exercise the power of eminent domain.
462462 (c) This section is not intended to be an expression of a
463463 legislative interpretation of the requirements of Section 17(c),
464464 Article I, Texas Constitution.
465465 SECTION 5. Except as provided by Section 4 of this Act, this
466466 Act takes effect September 1, 2011.
