12	12	relating to certain custom vehicles and street rods.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Subchapter B, Chapter 501, Transportation Code,
15	15	is amended by adding Section 501.038 to read as follows:
16	16	Sec. 501.038. CERTIFICATE OF TITLE FOR CUSTOM VEHICLE OR
17	17	STREET ROD. (a) In this section, "custom vehicle" and "street rod"
18	18	have the meanings assigned by Section 504.501.
19	19	(b) Notwithstanding any other provision of this chapter, if
20	20	the department issues a certificate of title for a custom vehicle or
21	21	street rod, the model year and make of the vehicle must be listed on
22	22	the certificate of title and must be the model year and make that
23	23	the body of the vehicle resembles. The certificate of title must
24	24	also include the word "replica."
25	25	(c) The owner of the custom vehicle or street rod shall
26	26	provide the department with documentation identifying the model
27	27	year and make that the body of the vehicle resembles.
28	28	SECTION 2. The heading to Section 504.501, Transportation
29	29	Code, as effective September 1, 2011, is amended to read as follows:
30	30	Sec. 504.501. CLASSIC MOTOR VEHICLES AND TRAVEL TRAILERS;
31	31	CUSTOM VEHICLES; STREET RODS.
32	32	SECTION 3. Section 504.501, Transportation Code, as
33	33	effective September 1, 2011, is amended by amending Subsection (a)
34	34	and adding Subsections (d), (e), and (f) to read as follows:
35	35	(a) The department shall issue specialty license plates for
36	36	a motor vehicle that is at least 25 years old or is a custom vehicle
37	37	or street rod. The license plates must include the word or words
38	38	"Classic," "Custom Vehicle," or "Street Rod," or a similar
39	39	designation, as appropriate.
40	40	(d) Notwithstanding Chapter 547, a custom vehicle or street
41	41	rod eligible to receive license plates under this section is not
42	42	required to be equipped with a specific piece of equipment unless
43	43	the specific piece of equipment was required by statute as a
44	44	condition of sale during the year listed as the model year on the
45	45	certificate of title.
46	46	(e) On initial registration of a custom vehicle or street
47	47	rod, the owner must provide proof, acceptable to the department,
48	48	that the custom vehicle or street rod passed a safety inspection
49	49	that has been approved by the department. The department shall
50	50	create a safety inspection process for inspecting custom vehicles
51	51	and street rods.
52	52	(f) In this section:
53	53	(1) "Custom vehicle" means a vehicle:
54	54	(A) that is:
55	55	(i) at least 25 years old and of a model
56	56	year after 1948; or
57	57	(ii) manufactured to resemble a vehicle
58	58	that is at least 25 years old and of a model year after 1948; and
59	59	(B) that:
60	60	(i) has been altered from the
61	61	manufacturer's original design; or
62	62	(ii) has a body constructed from materials
63	63	not original to the vehicle.
64	64	(2) "Street rod" means a vehicle:
65	65	(A) that was manufactured:
66	66	(i) before 1949; or
67	67	(ii) after 1948 to resemble a vehicle
68	68	manufactured before 1949; and
69	69	(B) that:
70	70	(i) has been altered from the
71	71	manufacturer's original design; or
72	72	(ii) has a body constructed from materials
73	73	not original to the vehicle.
74	74	SECTION 4. Section 548.052, Transportation Code, is amended
75	75	to read as follows:
76	76	Sec. 548.052. VEHICLES NOT SUBJECT TO INSPECTION. This
77	77	chapter does not apply to:
78	78	(1) a trailer, semitrailer, pole trailer, or mobile
79	79	home moving under or bearing a current factory-delivery license
80	80	plate or current in-transit license plate;
81	81	(2) a vehicle moving under or bearing a paper dealer
82	82	in-transit tag, machinery license, disaster license, parade
83	83	license, prorate tab, one-trip permit, antique license, custom
84	84	vehicle license, street rod license, temporary 24-hour permit, or
85	85	permit license;
86	86	(3) a trailer, semitrailer, pole trailer, or mobile
87	87	home having an actual gross weight or registered gross weight of
88	88	4,500 pounds or less;
89	89	(4) farm machinery, road-building equipment, a farm
90	90	trailer, or a vehicle required to display a slow-moving-vehicle
91	91	emblem under Section 547.703;
92	92	(5) a former military vehicle, as defined by Section
93	93	504.502 [502.275];
94	94	(6) a vehicle qualified for a tax exemption under
95	95	Section 152.092, Tax Code; or
96	96	(7) a vehicle for which a certificate of title has been
97	97	issued but that is not required to be registered.
98	98	SECTION 5. This Act takes effect September 1, 2011.
