1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to certain custom vehicles and street rods.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter B, Chapter 501, Transportation Code,
1515 is amended by adding Section 501.038 to read as follows:
1616 Sec. 501.038. CERTIFICATE OF TITLE FOR CUSTOM VEHICLE OR
1717 STREET ROD. (a) In this section, "custom vehicle" and "street rod"
1818 have the meanings assigned by Section 504.501.
1919 (b) Notwithstanding any other provision of this chapter, if
2020 the department issues a certificate of title for a custom vehicle or
2121 street rod, the model year and make of the vehicle must be listed on
2222 the certificate of title and must be the model year and make that
2323 the body of the vehicle resembles. The certificate of title must
2424 also include the word "replica."
2525 (c) The owner of the custom vehicle or street rod shall
2626 provide the department with documentation identifying the model
2727 year and make that the body of the vehicle resembles.
2828 SECTION 2. The heading to Section 504.501, Transportation
2929 Code, as effective September 1, 2011, is amended to read as follows:
3030 Sec. 504.501. CLASSIC MOTOR VEHICLES AND TRAVEL TRAILERS;
3131 CUSTOM VEHICLES; STREET RODS.
3232 SECTION 3. Section 504.501, Transportation Code, as
3333 effective September 1, 2011, is amended by amending Subsection (a)
3434 and adding Subsections (d), (e), and (f) to read as follows:
3535 (a) The department shall issue specialty license plates for
3636 a motor vehicle that is at least 25 years old or is a custom vehicle
3737 or street rod. The license plates must include the word or words
3838 "Classic," "Custom Vehicle," or "Street Rod," or a similar
3939 designation, as appropriate.
4040 (d) Notwithstanding Chapter 547, a custom vehicle or street
4141 rod eligible to receive license plates under this section is not
4242 required to be equipped with a specific piece of equipment unless
4343 the specific piece of equipment was required by statute as a
4444 condition of sale during the year listed as the model year on the
4545 certificate of title.
4646 (e) On initial registration of a custom vehicle or street
4747 rod, the owner must provide proof, acceptable to the department,
4848 that the custom vehicle or street rod passed a safety inspection
4949 that has been approved by the department. The department shall
5050 create a safety inspection process for inspecting custom vehicles
5151 and street rods.
5252 (f) In this section:
5353 (1) "Custom vehicle" means a vehicle:
5454 (A) that is:
5555 (i) at least 25 years old and of a model
5656 year after 1948; or
5757 (ii) manufactured to resemble a vehicle
5858 that is at least 25 years old and of a model year after 1948; and
5959 (B) that:
6060 (i) has been altered from the
6161 manufacturer's original design; or
6262 (ii) has a body constructed from materials
6363 not original to the vehicle.
6464 (2) "Street rod" means a vehicle:
6565 (A) that was manufactured:
6666 (i) before 1949; or
6767 (ii) after 1948 to resemble a vehicle
6868 manufactured before 1949; and
6969 (B) that:
7070 (i) has been altered from the
7171 manufacturer's original design; or
7272 (ii) has a body constructed from materials
7373 not original to the vehicle.
7474 SECTION 4. Section 548.052, Transportation Code, is amended
7575 to read as follows:
7676 Sec. 548.052. VEHICLES NOT SUBJECT TO INSPECTION. This
7777 chapter does not apply to:
7878 (1) a trailer, semitrailer, pole trailer, or mobile
7979 home moving under or bearing a current factory-delivery license
8080 plate or current in-transit license plate;
8181 (2) a vehicle moving under or bearing a paper dealer
8282 in-transit tag, machinery license, disaster license, parade
8383 license, prorate tab, one-trip permit, antique license, custom
8484 vehicle license, street rod license, temporary 24-hour permit, or
8585 permit license;
8686 (3) a trailer, semitrailer, pole trailer, or mobile
8787 home having an actual gross weight or registered gross weight of
8888 4,500 pounds or less;
8989 (4) farm machinery, road-building equipment, a farm
9090 trailer, or a vehicle required to display a slow-moving-vehicle
9191 emblem under Section 547.703;
9292 (5) a former military vehicle, as defined by Section
9393 504.502 [502.275];
9494 (6) a vehicle qualified for a tax exemption under
9595 Section 152.092, Tax Code; or
9696 (7) a vehicle for which a certificate of title has been
9797 issued but that is not required to be registered.
9898 SECTION 5. This Act takes effect September 1, 2011.
