| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 521.060(d), Transportation Code, as |
|---|
| 14 | 14 | | added by Chapter 1146 (H.B. 2730), Acts of the 81st Legislature, |
|---|
| 15 | 15 | | Regular Session, 2009, is amended to read as follows: |
|---|
| 16 | 16 | | (d) The department may disclose the results of an |
|---|
| 17 | 17 | | investigation under Subsection (c) to: |
|---|
| 18 | 18 | | (1) a criminal justice agency for the purposes of |
|---|
| 19 | 19 | | enforcing Section 521.4565 or other provisions of this chapter or |
|---|
| 20 | 20 | | Chapter 522; or |
|---|
| 21 | 21 | | (2) the secretary of state for voter registration |
|---|
| 22 | 22 | | purposes. |

| 23 | 23 | | SECTION 2. Chapter 15, Election Code, is amended by adding |
|---|
| 24 | 24 | | Subchapter G to read as follows: |
|---|
| 25 | 25 | | SUBCHAPTER G. USE OF CERTAIN INFORMATION FROM STATE AGENCY |
|---|
| 26 | 26 | | Sec. 15.171. ACTION ON INFORMATION PROVIDED BY DEPARTMENT |
|---|
| 27 | 27 | | OF PUBLIC SAFETY. (a) If the Department of Public Safety discloses |
|---|
| 28 | 28 | | to the secretary of state under Section 521.060, Transportation |
|---|
| 29 | 29 | | Code, as added by Chapter 1146 (H.B. 2730), Acts of the 81st |
|---|
| 30 | 30 | | Legislature, Regular Session, 2009, the results of an investigation |
|---|
| 31 | 31 | | conducted by the department relating to a unique address submitted |
|---|
| 32 | 32 | | in license or certificate applications determined by the department |
|---|
| 33 | 33 | | to be fraudulent, the secretary of state shall inform the voter |
|---|
| 34 | 34 | | registrar of the county in which the address is located. |
|---|
| 35 | 35 | | (b) A voter registrar who receives information relating to a |
|---|
| 36 | 36 | | unique address from the secretary of state under Subsection (a) |
|---|
| 37 | 37 | | shall: |
|---|
| 38 | 38 | | (1) investigate under Section 16.033 the registration |
|---|
| 39 | 39 | | of any voter registered to vote at that address; and |
|---|
| 40 | 40 | | (2) challenge under Section 13.074 the registration |
|---|
| 41 | 41 | | application of an applicant who submits the address as the voter's |
|---|
| 42 | 42 | | residence address on the application. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2011. |
