1010 system of the Department of Public Safety for voter registration
1111 purposes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 521.060(d), Transportation Code, as
1414 added by Chapter 1146 (H.B. 2730), Acts of the 81st Legislature,
1515 Regular Session, 2009, is amended to read as follows:
1616 (d) The department may disclose the results of an
1717 investigation under Subsection (c) to:
1818 (1) a criminal justice agency for the purposes of
1919 enforcing Section 521.4565 or other provisions of this chapter or
2020 Chapter 522; or
2121 (2) the secretary of state for voter registration
2222 purposes.
2323 SECTION 2. Chapter 15, Election Code, is amended by adding
2424 Subchapter G to read as follows:
2525 SUBCHAPTER G. USE OF CERTAIN INFORMATION FROM STATE AGENCY
2626 Sec. 15.171. ACTION ON INFORMATION PROVIDED BY DEPARTMENT
2727 OF PUBLIC SAFETY. (a) If the Department of Public Safety discloses
2828 to the secretary of state under Section 521.060, Transportation
2929 Code, as added by Chapter 1146 (H.B. 2730), Acts of the 81st
3030 Legislature, Regular Session, 2009, the results of an investigation
3131 conducted by the department relating to a unique address submitted
3232 in license or certificate applications determined by the department
3333 to be fraudulent, the secretary of state shall inform the voter
3434 registrar of the county in which the address is located.
3535 (b) A voter registrar who receives information relating to a
3636 unique address from the secretary of state under Subsection (a)
3737 shall:
3838 (1) investigate under Section 16.033 the registration
3939 of any voter registered to vote at that address; and
4040 (2) challenge under Section 13.074 the registration
4141 application of an applicant who submits the address as the voter's
4242 residence address on the application.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2011.
