| 9 | 9 | | relating to provision by the secretary of state of notice to a |

| 10 | 10 | | candidate of the form of the candidate's name that will appear on |
|---|
| 11 | 11 | | the general election ballot. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 161.008, Election Code, is amended by |
|---|
| 14 | 14 | | adding Subsection (d) to read as follows: |
|---|
| 15 | 15 | | (d) Not later than the 30th day before the date the |
|---|
| 16 | 16 | | secretary of state makes a certification under this section, the |
|---|
| 17 | 17 | | secretary of state shall provide notice by e-mail to each candidate |
|---|
| 18 | 18 | | to be included in the certification who has provided an e-mail |
|---|
| 19 | 19 | | address for that purpose. The notice must: |
|---|
| 20 | 20 | | (1) contain the exact form for which the candidate's |
|---|
| 21 | 21 | | name will be certified for placement on the ballot; and |
|---|
| 22 | 22 | | (2) provide information to the candidate on how errors |
|---|
| 23 | 23 | | in the form of the candidate's name may be corrected. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2011. |
