82R19509 NC-D By: Kleinschmidt H.J.R. No. 158 A JOINT RESOLUTION proposing a constitutional amendment releasing the state's claim of ownership or title to certain land in Lee County. BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Article 14, Texas Constitution, is amended by adding Section 2 to read as follows: Sec. 2. (a) The State of Texas relinquishes and releases any claim of sovereign ownership or title to any part of the tract of land, including mineral interests, described by metes and bounds in the Warranty Deed dated and filed on November 27, 1944, in Volume 89, page 199, of the Deed Records of Lee County as follows: Beginning at the southeast corner of the Scott Homestead on the Old Austin and Brenham Road; Thence N. 19 W. 900 varas to a stake for corner from which a Post Oak marked X bears N. 84 W. -- varas; Thence S. 80 W. 1677 varas to a stone for corner from which a Post Oak bears N. 88 E. 9-1/2 varas; Thence South 30 West 337 varas to a stone for corner from which a Post Oak marked X. bears south 40 east 12 varas; Thence S. 19 E. 522 varas to the Old Austin and Brenham road; Thence with said road at about North 80 E. 1380 varas to the place of beginning, containing about Two Hundred and Fifteen acres of land, more or less. (b) Title to the interest in the tract of land and minerals described by Subsection (a) of this section is confirmed to the person who, on the effective date of this section, holds the land under color of title that originated under the deed described by Subsection (a) of this section. SECTION 2. This proposed constitutional amendment shall be submitted to the voters at an election to be held November 8, 2011. The ballot shall be printed to permit voting for or against the proposition: "The constitutional amendment releasing the claim of the State of Texas of sovereign ownership or title to any part of a certain tract of land in Lee County that has been held under color of title that originated under a deed filed on November 27, 1944."
