77 relating to requiring public institutions of higher education to
88 notify the federal Student and Exchange Visitor Information System
99 (SEVIS) regarding the withdrawal or nonattendance of certain
1010 foreign students.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1313 amended by adding Section 51.9091 to read as follows:
1414 Sec. 51.9091. REQUIRED NOTIFICATION OF FEDERAL STUDENT AND
1515 EXCHANGE VISITOR INFORMATION SYSTEM (SEVIS) REGARDING WITHDRAWAL
1616 OR NONATTENDANCE OF CERTAIN FOREIGN STUDENTS. A public institution
1717 of higher education that is certified by the United States
1818 secretary of homeland security to enroll a foreign student admitted
1919 into the United States under a nonimmigrant F or M visa shall
2020 promptly notify the federal Student and Exchange Visitor
2121 Information System (SEVIS) or a successor program if:
2222 (1) a student enrolled under an F or M visa withdraws
2323 from the institution or withdraws from all courses in which the
2424 student is enrolled; or
2525 (2) the institution dismisses a student enrolled under
2626 an F or M visa for nonattendance or takes any other official
2727 administrative action in regard to the student as a result of the
2828 student's nonattendance.
2929 SECTION 2. This Act takes effect September 1, 2011.
