13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subsection (c), Section 155.051, Occupations |
---|
15 | 15 | | Code, is amended to read as follows: |
---|
16 | 16 | | (c) Subsections (a) and (b) do not apply to an [The time |
---|
17 | 17 | | frame to pass each part of the examination described by Subsection |
---|
18 | 18 | | (a) is extended to 10 years and the anniversary date to pass each |
---|
19 | 19 | | part of the examination described by Subsection (b) is extended to |
---|
20 | 20 | | the 10th anniversary if the] applicant who[: |
---|
21 | 21 | | [(1)] is specialty board certified by a specialty |
---|
22 | 22 | | board that: |
---|
23 | 23 | | (1) [(A)] is a member of the American Board of Medical |
---|
24 | 24 | | Specialties; or |
---|
25 | 25 | | (2) [(B)] is approved by the American Osteopathic |
---|
26 | 26 | | Association [a member of the Bureau of Osteopathic Specialists; or |
---|
27 | 27 | | [(2) has been issued a faculty temporary license, as |
---|
28 | 28 | | prescribed by board rule, and has practiced under such a license for |
---|
29 | 29 | | a minimum of 12 months and, at the conclusion of the 12-month |
---|
30 | 30 | | period, has been recommended to the board by the chief |
---|
31 | 31 | | administrative officer and the president of the institution in |
---|
32 | 32 | | which the applicant practiced under the faculty temporary license]. |
---|
33 | 33 | | SECTION 2. Subsection (d), Section 155.056, Occupations |
---|
34 | 34 | | Code, is amended to read as follows: |
---|
35 | 35 | | (d) The limitation on examination attempts by an applicant |
---|
36 | 36 | | under Subsection (a) does not apply to an applicant who[: |
---|
37 | 37 | | [(1) is licensed and in good standing as a physician in |
---|
38 | 38 | | another state; |
---|
39 | 39 | | [(2) has been licensed for at least five years; |
---|
40 | 40 | | [(3) does not hold a medical license in the other state |
---|
41 | 41 | | that has any restrictions, disciplinary orders, or probation; and |
---|
42 | 42 | | [(4) passed all but one part of the examination |
---|
43 | 43 | | approved by the board within three attempts and: |
---|
44 | 44 | | [(A) passed the remaining part of the examination |
---|
45 | 45 | | within one additional attempt; or |
---|
46 | 46 | | [(B) passed the remaining part of the examination |
---|
47 | 47 | | within six attempts if the applicant: |
---|
48 | 48 | | [(i)] is specialty board certified by a |
---|
49 | 49 | | specialty board that: |
---|
50 | 50 | | (1) [(a)] is a member of the American Board of Medical |
---|
51 | 51 | | Specialties; or |
---|
52 | 52 | | (2) [(b)] is approved by the American Osteopathic |
---|
53 | 53 | | Association[; and |
---|
54 | 54 | | [(ii) has completed in this state an |
---|
55 | 55 | | additional two years of postgraduate medical training approved by |
---|
56 | 56 | | the board]. |

57 | 57 | | SECTION 3. This Act takes effect September 1, 2011. |
