1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to certain examination requirements for physicians.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (c), Section 155.051, Occupations
1515 Code, is amended to read as follows:
1616 (c) Subsections (a) and (b) do not apply to an [The time

1919 part of the examination described by Subsection (b) is extended to
2020 the 10th anniversary if the] applicant who[:
2121 [(1)] is specialty board certified by a specialty

2323 (1) [(A)] is a member of the American Board of Medical
2424 Specialties; or
2525 (2) [(B)] is approved by the American Osteopathic
2626 Association [a member of the Bureau of Osteopathic Specialists; or
2727 [(2) has been issued a faculty temporary license, as
2828 prescribed by board rule, and has practiced under such a license for
2929 a minimum of 12 months and, at the conclusion of the 12-month
3030 period, has been recommended to the board by the chief
3131 administrative officer and the president of the institution in
3232 which the applicant practiced under the faculty temporary license].
3333 SECTION 2. Subsection (d), Section 155.056, Occupations
3434 Code, is amended to read as follows:
3535 (d) The limitation on examination attempts by an applicant
3636 under Subsection (a) does not apply to an applicant who[:
3737 [(1) is licensed and in good standing as a physician in
3838 another state;
3939 [(2) has been licensed for at least five years;
4040 [(3) does not hold a medical license in the other state
4141 that has any restrictions, disciplinary orders, or probation; and
4242 [(4) passed all but one part of the examination
4343 approved by the board within three attempts and:
4444 [(A) passed the remaining part of the examination
4545 within one additional attempt; or
4646 [(B) passed the remaining part of the examination
4747 within six attempts if the applicant:
4848 [(i)] is specialty board certified by a
4949 specialty board that:
5050 (1) [(a)] is a member of the American Board of Medical
5151 Specialties; or
5252 (2) [(b)] is approved by the American Osteopathic
5353 Association[; and
5454 [(ii) has completed in this state an
5555 additional two years of postgraduate medical training approved by
5656 the board].
5757 SECTION 3. This Act takes effect September 1, 2011.
