99 AN ACT
1010 relating to the graduate medical training requirements for certain
1111 foreign medical school graduates applying for a license to practice
1212 medicine in this state.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subsection (a), Section 155.003, Occupations
1515 Code, is amended to read as follows:
1616 (a) To be eligible for a license under this chapter, an
1717 applicant must present proof satisfactory to the board that the
1818 applicant:
1919 (1) is at least 21 years of age;
2020 (2) is of good professional character and has not
2121 violated Section 164.051, 164.052, or 164.053;
2222 (3) has completed:
2323 (A) at least 60 semester hours of college
2424 courses, other than courses in medical school, that are acceptable
2525 to The University of Texas at Austin for credit on a bachelor of
2626 arts degree or a bachelor of science degree;
2727 (B) the entire primary, secondary, and
2828 premedical education required in the country of medical school
2929 graduation, if the medical school is located outside the United
3030 States or Canada; or
3131 (C) substantially equivalent courses as
3232 determined by board rule;
3333 (4) is a graduate of a medical school located in the
3434 United States or Canada and approved by the board;
3535 (5) has either:
3636 (A) successfully completed one year of graduate
3737 medical training approved by the board in the United States or
3838 Canada; or
3939 (B) graduated from a medical school located
4040 outside the United States or Canada and has successfully completed
4141 two [three] years of graduate medical training approved by the
4242 board in the United States or Canada;
4343 (6) has passed an examination accepted or administered
4444 by the board; and
4545 (7) has passed a Texas medical jurisprudence
4646 examination as determined by board rule.
4747 SECTION 2. Section 155.004, Occupations Code, is amended to
4848 read as follows:
4949 Sec. 155.004. ADDITIONAL ELIGIBILITY REQUIREMENTS FOR
5050 GRADUATES OF CERTAIN FOREIGN MEDICAL SCHOOLS. A license applicant
5151 who is a graduate of a medical school that is located outside the
5252 United States and Canada must present proof satisfactory to the
5353 board that the applicant:
5454 (1) is a graduate of a school whose curriculum meets
5555 the requirements for an unapproved medical school as determined by
5656 a committee of experts selected by the Texas Higher Education
5757 Coordinating Board;
5858 (2) has successfully completed[:
5959 [(A) at least three years of graduate medical
6060 training in the United States or Canada that was approved by the
6161 board; or
6262 [(B)] at least two years of graduate medical
6363 training in the United States or Canada that was approved by the
6464 board [and at least one year of graduate medical training outside
6565 the United States or Canada that was approved for advanced standing
6666 by a specialty board organization approved by the board];
6767 (3) holds a valid certificate issued by the
6868 Educational Commission for Foreign Medical Graduates; and
6969 (4) is able to communicate in English.
7070 SECTION 3. Subsection (a), Section 155.005, Occupations
7171 Code, is amended to read as follows:
7272 (a) To be eligible for a license under this chapter, an
7373 applicant who has been a student of a foreign medical school must
7474 present proof satisfactory to the board that the applicant:
7575 (1) meets the requirements of Section 155.003;
7676 (2) has studied medicine in a medical school located
7777 outside the United States and Canada that is acceptable to the
7878 board;
7979 (3) has completed all of the didactic work of the
8080 foreign medical school but has not graduated from the school;
8181 (4) has attained a score satisfactory to a medical
8282 school in the United States approved by the Liaison Committee on
8383 Medical Education on a qualifying examination and has
8484 satisfactorily completed one academic year of supervised clinical
8585 training for foreign medical students, as defined by the American
8686 Medical Association Council on Medical Education (Fifth Pathway
8787 Program), under the direction of the medical school in the United
8888 States;
8989 (5) has attained a passing score on the Educational
9090 Commission for Foreign Medical Graduates examination or another
9191 examination, if required by the board;
9292 (6) has successfully completed at least two [three]
9393 years of graduate medical training in the United States or Canada
9494 that was approved by the board as of the date the training was
9595 completed; and
9696 (7) has passed the license examination under
9797 Subchapter B required by the board of each applicant.
9898 SECTION 4. The changes in law made by this Act to Sections
9999 155.003, 155.004, and 155.005, Occupations Code, apply only to an
100100 application for a license to practice medicine submitted to the
101101 Texas Medical Board on or after the effective date of this Act. An
102102 application for a license submitted before that date is governed by
103103 the law in effect on the date the application was submitted, and the
104104 former law is continued in effect for that purpose.
105105 SECTION 5. This Act takes effect September 1, 2011.
