77 relating to information regarding deceased registered voters.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 16.001, Election Code, is amended by
1010 adding Subsection (d) to read as follows:
1111 (d) The secretary of state shall quarterly obtain from the
1212 United States Social Security Administration available information
1313 specified by the secretary relating to deceased residents of the
1414 state and compare the information received to the statewide
1515 computerized voter registration list. If the secretary determines
1616 that a voter on the registration list is deceased, the secretary
1717 shall send notice of the determination to the voter registrar of the
1818 counties considered appropriate by the secretary.
1919 SECTION 2. Subsection (b), Section 16.031, Election Code,
2020 is amended to read as follows:
2121 (b) The registrar shall cancel a voter's registration
2222 immediately if the registrar:
2323 (1) determines from information received under
2424 Section 16.001(c) that the voter is deceased;
2525 (2) has personal knowledge that the voter is deceased;
2626 [or]
2727 (3) receives from a person related within the second
2828 degree by consanguinity or affinity, as determined under Chapter
2929 573, Government Code, to the voter a sworn statement by that person
3030 indicating that the voter is deceased; or
3131 (4) receives notice from the secretary of state under
3232 Section 16.001(d) that the voter is deceased.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2011.
