7 | 7 | | relating to information regarding deceased registered voters. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 16.001, Election Code, is amended by |
---|
10 | 10 | | adding Subsection (d) to read as follows: |
---|
11 | 11 | | (d) The secretary of state shall quarterly obtain from the |
---|
12 | 12 | | United States Social Security Administration available information |
---|
13 | 13 | | specified by the secretary relating to deceased residents of the |
---|
14 | 14 | | state and compare the information received to the statewide |
---|
15 | 15 | | computerized voter registration list. If the secretary determines |
---|
16 | 16 | | that a voter on the registration list is deceased, the secretary |
---|
17 | 17 | | shall send notice of the determination to the voter registrar of the |
---|
18 | 18 | | counties considered appropriate by the secretary. |

19 | 19 | | SECTION 2. Subsection (b), Section 16.031, Election Code, |
---|
20 | 20 | | is amended to read as follows: |
---|
21 | 21 | | (b) The registrar shall cancel a voter's registration |
---|
22 | 22 | | immediately if the registrar: |
---|
23 | 23 | | (1) determines from information received under |
---|
24 | 24 | | Section 16.001(c) that the voter is deceased; |
---|
25 | 25 | | (2) has personal knowledge that the voter is deceased; |
---|
26 | 26 | | [or] |
---|
27 | 27 | | (3) receives from a person related within the second |
---|
28 | 28 | | degree by consanguinity or affinity, as determined under Chapter |
---|
29 | 29 | | 573, Government Code, to the voter a sworn statement by that person |
---|
30 | 30 | | indicating that the voter is deceased; or |
---|
31 | 31 | | (4) receives notice from the secretary of state under |
---|
32 | 32 | | Section 16.001(d) that the voter is deceased. |
---|
33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
---|
34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
---|
35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
---|
37 | 37 | | Act takes effect September 1, 2011. |
