1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 2165.2035, Government
1313 Code, is amended to read as follows:
1414 Sec. 2165.2035. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
1515 AND GARAGES; PRIVATE COMMERCIAL USE.
1616 SECTION 2. Subchapter E, Chapter 2165, Government Code, is
1717 amended by adding Sections 2165.204, 2165.2045, and 2165.2046 to
1818 read as follows:
1919 Sec. 2165.204. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
2020 AND GARAGES; PRIVATE INDIVIDUAL USE OF EXCESS INDIVIDUAL PARKING
2121 SPACES. (a) The commission may lease to a private individual an
2222 individual parking space in a state-owned parking lot or garage
2323 located in the city of Austin if the commission determines the
2424 parking space to be in excess of the number of parking spaces
2525 sufficient to accommodate the regular parking requirements of state
2626 employees employed near the lot or garage and visitors to nearby
2727 state government offices.
2828 (b) Money received from a lease under this section shall be
2929 deposited to the credit of the general revenue fund.
3030 (c) In leasing a parking space under Subsection (a), the
3131 commission must ensure that the lease does not restrict uses for
3232 parking lots and garages developed under Section 2165.2035,
3333 including special event parking related to institutions of higher
3434 education.
3535 (d) In leasing or renewing a lease for a parking space under
3636 Subsection (a), the commission shall give preference to an
3737 individual who is currently leasing or previously leased the
3838 parking space.
3939 Sec. 2165.2045. LEASE OF SPACE IN STATE-OWNED PARKING LOTS
4040 AND GARAGES; CERTAIN GOVERNMENTAL ENTITIES USE OF EXCESS BLOCKS OF
4141 PARKING SPACE. (a) The commission may lease to an institution of
4242 higher education or a local government all or a significant block of
4343 a state-owned parking lot or garage located in the city of Austin if
4444 the commission determines the parking spaces located in the lot or
4545 garage to be in excess of the number of parking spaces sufficient to
4646 accommodate the regular parking requirements of state employees
4747 employed near the lot or garage and visitors to nearby state
4848 government offices.
4949 (b) Money received from a lease under this section shall be
5050 deposited to the credit of the general revenue fund.
5151 (c) In leasing all or a block of a state-owned parking lot or
5252 garage under Subsection (a), the commission must ensure that the
5353 lease does not restrict uses for parking lots and garages developed
5454 under Section 2165.2035, including special event parking related to
5555 institutions of higher education.
5656 (d) In leasing or renewing a lease for all or a block of a
5757 state-owned parking lot or garage under Subsection (a), the
5858 commission shall give preference to an entity that is currently
5959 leasing or previously leased the lot or garage or a block of the lot
6060 or garage.
6161 Sec. 2165.2046. REPORTS ON PARKING PROGRAMS. On or before
6262 October 1 of each even-numbered year, the commission shall submit a
6363 report to the Legislative Budget Board describing the effectiveness
6464 of parking programs developed by the commission under this
6565 subchapter. The report must, at a minimum, include:
6666 (1) the yearly revenue generated by the programs;
6767 (2) the yearly administrative and enforcement costs of
6868 each program;
6969 (3) yearly usage statistics for each program; and
7070 (4) initiatives and suggestions by the commission to:
7171 (A) modify administration of the programs; and
7272 (B) increase revenue generated by the programs.
7373 SECTION 3. This Act takes effect immediately if it receives
7474 a vote of two-thirds of all the members elected to each house, as
7575 provided by Section 39, Article III, Texas Constitution. If this
7676 Act does not receive the vote necessary for immediate effect, this
7777 Act takes effect September 1, 2011.
