                    LEGISLATIVE BUDGET BOARD    Austin, Texas      FISCAL NOTE, 82ND LEGISLATIVE REGULAR SESSION            May 5, 2011      TO: Honorable Harvey Hilderbran, Chair, House Committee on Ways & Means      FROM: John S O'Brien, Director, Legislative Budget Board     IN RE:SB1070 by Jackson (Relating to the composition of the permanent advisory committee to advise the Texas Commission on Environmental Quality regarding the implementation of the ad valorem tax exemption for pollution control property.), As Engrossed    No significant fiscal implication to the State is anticipated.  The bill would require that at least one of the Tax Relief for Pollution Control Property Advisory Committee members be a representative of a school district or junior college district in which property is located that is or previously was subject to an exemption under Tax Code, Section 11.31.  The Texas Commission on Environmental Quality (TCEQ) would be required to appoint the new member(s) as soon as practicable after the act becomes law on September 1, 2011 or immediately if it receives a vote of two-thirds of all the members elected to each house.   No significant fiscal implications to the TCEQ are expected as a result of the bill's passage.
