| 9 | 9 | | implementation of the ad valorem tax exemption for pollution |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Subsection (n), Section 11.31, Tax Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (n) The Texas Commission on Environmental Quality shall |
|---|
| 15 | 15 | | establish a permanent advisory committee consisting of |
|---|
| 16 | 16 | | representatives of industry, appraisal districts, taxing units, |
|---|
| 17 | 17 | | and environmental groups, as well as members who are not |
|---|
| 18 | 18 | | representatives of any of those entities but have substantial |
|---|
| 19 | 19 | | technical expertise in pollution control technology and |
|---|
| 20 | 20 | | environmental engineering, to advise the commission regarding the |
|---|
| 21 | 21 | | implementation of this section. At least one member of the advisory |
|---|
| 22 | 22 | | committee must be a representative of a school district or junior |
|---|
| 23 | 23 | | college district in which property is located that is or previously |
|---|
| 24 | 24 | | was subject to an exemption under this section. Chapter 2110, |
|---|
| 25 | 25 | | Government Code, does not apply to the size, composition, or |
|---|
| 26 | 26 | | duration of the advisory committee. |
|---|
| 27 | 27 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 28 | 28 | | of this Act, the Texas Commission on Environmental Quality shall |
|---|
| 29 | 29 | | appoint one or more representatives of school districts or junior |
|---|
| 30 | 30 | | college districts in which property is located that is or |
|---|
| 31 | 31 | | previously was subject to an exemption under Section 11.31, Tax |
|---|
| 32 | 32 | | Code, to the permanent advisory committee established under |
|---|
| 33 | 33 | | Subsection (n) of that section, as amended by this Act. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2011. |
