77 relating to the composition of the permanent advisory committee to
88 advise the Texas Commission on Environmental Quality regarding the
99 implementation of the ad valorem tax exemption for pollution
1010 control property.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (n), Section 11.31, Tax Code, is
1313 amended to read as follows:
1414 (n) The Texas Commission on Environmental Quality shall
1515 establish a permanent advisory committee consisting of
1616 representatives of industry, appraisal districts, taxing units,
1717 and environmental groups, as well as members who are not
1818 representatives of any of those entities but have substantial
1919 technical expertise in pollution control technology and
2020 environmental engineering, to advise the commission regarding the
2121 implementation of this section. At least one member of the advisory
2222 committee must be a representative of a school district or junior
2323 college district in which property is located that is or previously
2424 was subject to an exemption under this section. Chapter 2110,
2525 Government Code, does not apply to the size, composition, or
2626 duration of the advisory committee.
2727 SECTION 2. As soon as practicable after the effective date
2828 of this Act, the Texas Commission on Environmental Quality shall
2929 appoint one or more representatives of school districts or junior
3030 college districts in which property is located that is or
3131 previously was subject to an exemption under Section 11.31, Tax
3232 Code, to the permanent advisory committee established under
3333 Subsection (n) of that section, as amended by this Act.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2011.
