99 AN ACT
1010 relating to the venue for prosecution of certain theft offenses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (a), Article 13.08, Code of Criminal
1313 Procedure, is amended to read as follows:
1414 (a) Where property is stolen in one county and removed [by
1515 the offender] to another county, the offender may be prosecuted
1616 either in the county in which [where he took] the property was
1717 stolen or in any other county through or into which the property was
1818 [he may have] removed [the same].
1919 SECTION 2. This Act applies only to a criminal case in which
2020 the indictment, information, or complaint is presented to the court
2121 on or after the effective date of this Act. A criminal case in which
2222 the indictment, information, or complaint was presented to the
2323 court before the effective date of this Act is governed by the law
2424 in effect when the indictment, information, or complaint was
2525 presented, and the former law is continued in effect for that
2626 purpose.
2727 SECTION 3. This Act takes effect September 1, 2011.
