99 AN ACT
1010 relating to the prosecution of a parent contributing to the
1111 nonattendance of a public school student.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subsection (a), Section 25.093, Education Code,
1414 is amended to read as follows:
1515 (a) If a warning is issued as required by Section 25.095(a),
1616 the parent intentionally [with criminal negligence] fails to
1717 require the child to attend school as required by law, and the child
1818 has absences for the amount of time specified under Section 25.094,
1919 the parent commits an offense.
2020 SECTION 2. The change in law made by this Act applies only
2121 to an offense committed on or after the effective date of this Act.
2222 An offense committed before the effective date of this Act is
2323 governed by the law in effect at the time the offense was committed,
2424 and the former law is continued in effect for that purpose. For
2525 purposes of this section, an offense was committed before the
2626 effective date of this Act if any element of the offense occurred
2727 before that date.
2828 SECTION 3. This Act takes effect September 1, 2011.
