| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subsection (b), Section 13.113, Agriculture | |
| 11 | 11 | Code, is amended to read as follows: | |
| 12 | 12 | (b) The department shall maintain the primary [official] | |
| 13 | 13 | standards in a safe and suitable place in the offices of the | |
| 14 | 14 | department. The standards may not be moved except for repairs or | |
| 15 | 15 | certification. The department shall maintain the standards in good | |
| 16 | 16 | order and shall submit them to the National Institute of Standards | |
| 17 | 17 | and Technology or to a laboratory approved by the National | |
| 18 | 18 | Institute of Standards and Technology for certification at least | |
| 19 | 19 | once each 10 years. | |
| 20 | 20 | SECTION 2. This Act takes effect September 1, 2011. |
