99 relating to the adoption by health care facilities of a policy on
1010 vaccine preventable diseases; imposing penalties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subtitle A, Title 4, Health and
1313 Safety Code, is amended to read as follows:
1414 SUBTITLE A. FINANCING, CONSTRUCTING, REGULATING, AND INSPECTING
1515 HEALTH FACILITIES
1616 SECTION 2. Subtitle A, Title 4, Health and Safety Code, is
1717 amended by adding Chapter 224 to read as follows:
1818 CHAPTER 224. POLICY ON VACCINE PREVENTABLE DISEASES
1919 Sec. 224.001. DEFINITIONS. In this chapter:
2020 (1) "Covered individual" means:
2121 (A) an employee of the health care facility;
2222 (B) an individual providing direct patient care
2323 under a contract with a health care facility; or
2424 (C) an individual to whom a health care facility
2525 has granted privileges to provide direct patient care.
2626 (2) "Health care facility" means:
2727 (A) a facility licensed under Subtitle B,
2828 including a hospital as defined by Section 241.003; or
2929 (B) a hospital maintained or operated by this
3030 state.
3131 (3) "Regulatory authority" means a state agency that
3232 regulates a health care facility under this code.
3333 (4) "Vaccine preventable diseases" means the diseases
3434 included in the most current recommendations of the Advisory
3535 Committee on Immunization Practices of the Centers for Disease
3636 Control and Prevention.
3737 Sec. 224.002. VACCINE PREVENTABLE DISEASES POLICY
3838 REQUIRED. (a) Each health care facility shall develop and
3939 implement a policy to protect its patients from vaccine preventable
4040 diseases.
4141 (b) The policy must:
4242 (1) require covered individuals to receive vaccines
4343 for the vaccine preventable diseases specified by the facility
4444 based on the level of risk the individual presents to patients by
4545 the individual's routine and direct exposure to patients;
4646 (2) specify the vaccines a covered individual is
4747 required to receive based on the level of risk the individual
4848 presents to patients by the individual's routine and direct
4949 exposure to patients;
5050 (3) include procedures for verifying whether a covered
5151 individual has complied with the policy;
5252 (4) include procedures for a covered individual to be
5353 exempt from the required vaccines for the medical conditions
5454 identified as contraindications or precautions by the Centers for
5555 Disease Control and Prevention;
5656 (5) for a covered individual who is exempt from the
5757 required vaccines, include procedures the individual must follow to
5858 protect facility patients from exposure to disease, such as the use
5959 of protective medical equipment, such as gloves and masks, based on
6060 the level of risk the individual presents to patients by the
6161 individual's routine and direct exposure to patients;
6262 (6) prohibit discrimination or retaliatory action
6363 against a covered individual who is exempt from the required
6464 vaccines for the medical conditions identified as
6565 contraindications or precautions by the Centers for Disease Control
6666 and Prevention, except that required use of protective medical
6767 equipment, such as gloves and masks, may not be considered
6868 retaliatory action for purposes of this subdivision;
6969 (7) require the health care facility to maintain a
7070 written or electronic record of each covered individual's
7171 compliance with or exemption from the policy; and
7272 (8) include disciplinary actions the health care
7373 facility is authorized to take against a covered individual who
7474 fails to comply with the policy.
7575 (c) The policy may include procedures for a covered
7676 individual to be exempt from the required vaccines based on reasons
7777 of conscience, including a religious belief.
7878 Sec. 224.003. DISASTER EXEMPTION. (a) In this section,
7979 "public health disaster" has the meaning assigned by Section
8080 81.003.
8181 (b) During a public health disaster, a health care facility
8282 may prohibit a covered individual who is exempt from the vaccines
8383 required in the policy developed by the facility under Section
8484 224.002 from having contact with facility patients.
8585 Sec. 224.004. DISCIPLINARY ACTION. A health care facility
8686 that violates this chapter is subject to an administrative or civil
8787 penalty in the same manner, and subject to the same procedures, as
8888 if the facility had violated a provision of this code that
8989 specifically governs the facility.
9090 Sec. 224.005. RULES. The appropriate rulemaking authority
9191 for each regulatory authority shall adopt rules necessary to
9292 implement this chapter.
9393 SECTION 3. Not later than June 1, 2012, a state agency that
9494 regulates a health care facility subject to Chapter 224, Health and
9595 Safety Code, as added by this Act, shall adopt the rules necessary
9696 to implement that chapter.
9797 SECTION 4. Notwithstanding Chapter 224, Health and Safety
9898 Code, as added by this Act, a health care facility subject to that
9999 chapter is not required to have a policy on vaccine preventable
100100 diseases in effect until September 1, 2012.
101101 SECTION 5. This Act takes effect September 1, 2011.
