11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subdivision (2), Subsection (a), Section |
---|
13 | 13 | | 531.0223, Government Code, is amended to read as follows: |
---|
14 | 14 | | (2) "Committee" means the advisory committee on |
---|
15 | 15 | | Medicaid and child health plan program rate and expenditure |
---|
16 | 16 | | [funding] disparities between the Texas-Mexico border region and |
---|
17 | 17 | | other areas of the state [in health programs] appointed by the |
---|
18 | 18 | | executive commissioner under this section. |
---|
19 | 19 | | SECTION 2. Subsections (b) through (e), (o), and (p), |
---|
20 | 20 | | Section 531.0223, Government Code, are amended to read as follows: |
---|
21 | 21 | | (b) The executive commissioner shall appoint an advisory |
---|
22 | 22 | | committee to develop a strategic plan for eliminating the |
---|
23 | 23 | | disparities between the Texas-Mexico border region and other areas |
---|
24 | 24 | | of the state in: |
---|
25 | 25 | | (1) capitation rates under Medicaid managed care and |
---|
26 | 26 | | the child health plan program for services provided to persons |
---|
27 | 27 | | younger than 19 years of age; |
---|
28 | 28 | | (2) fee-for-service per capita expenditures under the |
---|
29 | 29 | | Medicaid program and the child health plan program for inpatient |
---|
30 | 30 | | and outpatient hospital services for services provided to persons |
---|
31 | 31 | | younger than 19 years of age; and |
---|
32 | 32 | | (3) total professional services expenditures per |
---|
33 | 33 | | Medicaid recipient younger than 19 years of age or per child |
---|
34 | 34 | | enrolled in the child health plan program. |
---|
35 | 35 | | (c) Periodically the committee shall perform the research |
---|
36 | 36 | | necessary to analyze and compare the rates and expenditures |
---|
37 | 37 | | described by Subsection (b) and, not later than the date specified |
---|
38 | 38 | | by the executive commissioner, produce a report based on the |
---|
39 | 39 | | results of that analysis and comparison. |
---|
40 | 40 | | (d) The committee shall, as part of the report required by |
---|
41 | 41 | | Subsection (c), make recommendations to the executive commissioner |
---|
42 | 42 | | for addressing the problems created by disparities documented in |
---|
43 | 43 | | the report, including recommendations for allocation of funds. |
---|
44 | 44 | | (e) The executive commissioner shall appoint nine members |
---|
45 | 45 | | to the advisory committee in a manner that ensures that the |
---|
46 | 46 | | committee: |
---|
47 | 47 | | (1) represents the spectrum of geographic areas |
---|
48 | 48 | | included in the Texas-Mexico border region; |
---|
49 | 49 | | (2) includes persons who are knowledgeable regarding |
---|
50 | 50 | | the Medicaid program, including Medicaid managed care, and the |
---|
51 | 51 | | child health plan program; and |
---|
52 | 52 | | (3) represents the interests of physicians, |
---|
53 | 53 | | hospitals, patients, managed care organizations, state agencies |
---|
54 | 54 | | involved in the management and delivery of medical resources of any |
---|
55 | 55 | | kind, affected communities, and other areas of the state. |
---|
56 | 56 | | (o) The commission shall [contract with a public university |
---|
57 | 57 | | to]: |
---|
58 | 58 | | (1) measure changes occurring from September 1, 2002 |
---|
59 | 59 | | [2001], to August 31, 2014 [2004], in the number of health care |
---|
60 | 60 | | providers participating in the Medicaid program or the child health |
---|
61 | 61 | | plan program in the Texas-Mexico border region and resulting |
---|
62 | 62 | | effects on consumer access to health care and consumer utilization; |
---|
63 | 63 | | (2) determine: |
---|
64 | 64 | | (A) the effects, if any, of the changes in rates |
---|
65 | 65 | | and expenditures required by Subsection (k); and |
---|
66 | 66 | | (B) if funding available and used for changes in |
---|
67 | 67 | | rates and expenditures was sufficient to produce measurable |
---|
68 | 68 | | effects; |
---|
69 | 69 | | (3) make a recommendation regarding whether Medicaid |
---|
70 | 70 | | rate increases should be expanded to include Medicaid services |
---|
71 | 71 | | provided to adults in the Texas-Mexico border region; and |
---|
72 | 72 | | (4) not later than December 1, 2014 [2004], submit a |
---|
73 | 73 | | report to the legislature. |
---|
74 | 74 | | (p) This section expires September 1, 2015 [2011]. |
---|
75 | 75 | | SECTION 3. The advisory committee on Medicaid and child |
---|
76 | 76 | | health plan program rate and expenditure disparities between the |
---|
77 | 77 | | Texas-Mexico border region and other areas of the state is |
---|
78 | 78 | | re-created in accordance with Section 531.0223, Government Code, as |
---|
79 | 79 | | amended by this Act. Not later than December 1, 2011, the executive |
---|
80 | 80 | | commissioner of the Health and Human Services Commission shall |
---|
81 | 81 | | appoint the members of the advisory committee as required by that |
---|
82 | 82 | | section. |
---|
83 | 83 | | SECTION 4. This Act takes effect immediately if it receives |
---|
84 | 84 | | a vote of two-thirds of all the members elected to each house, as |
---|
85 | 85 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
86 | 86 | | Act does not receive the vote necessary for immediate effect, this |
---|
87 | 87 | | Act takes effect on the 91st day after the last day of the |
---|
88 | 88 | | legislative session. |
