77 relating to the registration with the Texas Department of Insurance
88 of certain contract examiners.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 401.107, Insurance Code, is amended by
1111 amending Subsection (a) and adding Subsection (a-1) to read as
1212 follows:
1313 (a) A person with whom another state contracts to perform
1414 any examination initiated by the other state of an insurer
1515 domiciled in this state shall register with and provide the
1616 following information to the department's chief examiner:
1717 (1) the person's name;
1818 (2) if the person is not an individual, the identity of
1919 each examiner or other person who will perform any part of the
2020 examination;
2121 (3) the name of the state that contracted with the
2222 person;
2323 (4) the identity of the insurer to be examined; [and]
2424 (5) a description of each issue that the person has
2525 been contracted to examine;
2626 (6) an estimate of the examination costs to be charged
2727 to the insurer to be examined;
2828 (7) a copy of any contract between the person and the
2929 state regulatory body that initiated the examination and a letter
3030 authorizing the examination; and
3131 (8) a list of the previous examinations conducted on
3232 the same insurer on behalf of any state within the last three years.
3333 (a-1) On accepting a person's registration under Subsection
3434 (a), the department shall send written confirmation of the
3535 acceptance to:
3636 (1) the person;
3737 (2) the insurer to be examined; and
3838 (3) the state regulatory body that initiated the
3939 examination.
4040 SECTION 2. Section 751.052, Insurance Code, is amended by
4141 amending Subsection (b) and adding Subsection (b-1) to read as
4242 follows:
4343 (b) A person with whom another state contracts to perform
4444 any market analysis or examination initiated by the other state of
4545 an insurer domiciled in this state shall register with and provide
4646 the following information to the department's chief examiner:
4747 (1) the person's name;
4848 (2) if the person is not an individual, the identity of
4949 each examiner or other person who will perform any part of the
5050 market analysis or examination;
5151 (3) the name of the state that contracted with the
5252 person;
5353 (4) the identity of the insurer to be examined; [and]
5454 (5) a description of each issue that the person has
5555 been contracted to examine;
5656 (6) an estimate of the examination costs to be charged
5757 to the insurer to be examined;
5858 (7) a copy of any contract between the person and the
5959 state regulatory body that initiated the examination and the letter
6060 authorizing the examination; and
6161 (8) a list of the previous examinations conducted on
6262 the same insurer on behalf of any state within the last three years.
6363 (b-1) On accepting a person's registration under Subsection
6464 (b), the department shall send written confirmation of the
6565 acceptance to:
6666 (1) the person;
6767 (2) the insurer to be examined; and
6868 (3) the state regulatory body that initiated the
6969 examination.
7070 SECTION 3. Section 4053.107, Insurance Code, is amended by
7171 amending Subsection (d) and adding Subsection (d-1) to read as
7272 follows:
7373 (d) A person with whom another state contracts to perform
7474 any examination initiated by the other state of a managing general
7575 agent licensed under this chapter shall register with and provide
7676 the following information to the department's chief examiner:
7777 (1) the person's name;
7878 (2) if the person is not an individual, the identity of
7979 each examiner or other person who will perform any part of the
8080 examination;
8181 (3) the name of the state that contracted with the
8282 person;
8383 (4) the identity of the managing general agent to be
8484 examined; [and]
8585 (5) a description of each issue that the person has
8686 been contracted to examine;
8787 (6) an estimate of the examination costs to be charged
8888 to the managing general agent to be examined;
8989 (7) a copy of any contract between the person and the
9090 state regulatory body that initiated the examination and the letter
9191 authorizing the examination; and
9292 (8) a list of the previous examinations conducted on
9393 the same managing general agent on behalf of any state within the
9494 last three years.
9595 (d-1) On accepting a person's registration under Subsection
9696 (d), the department shall send written confirmation of the
9797 acceptance to:
9898 (1) the person;
9999 (2) the managing general agent to be examined; and
100100 (3) the state regulatory body that initiated the
101101 examination.
102102 SECTION 4. The changes in law made by this Act to Sections
103103 401.107, 751.052, and 4053.107, Insurance Code, apply only to an
104104 examination commencing on or after September 1, 2011. An
105105 examination commencing before September 1, 2011, is subject to the
106106 law in effect on the date the examination was commenced, and that
107107 law is continued in effect for that purpose.
108108 SECTION 5. This Act takes effect immediately if it receives
109109 a vote of two-thirds of all the members elected to each house, as
110110 provided by Section 39, Article III, Texas Constitution. If this
111111 Act does not receive the vote necessary for immediate effect, this
112112 Act takes effect September 1, 2011.
