8	8	AN ACT
9	9	relating to the applicability of certain restrictions on the
10	10	location and operation of concrete crushing facilities.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 382.065(b), Health and Safety Code, is
13	13	amended to read as follows:
14	14	(b) Subsection (a) does not apply to a concrete crushing
15	15	facility:
16	16	(1) at a location for which commission authorization
17	17	for the operation of a concrete crushing facility was in effect on
18	18	September 1, 2001; [or]
19	19	(2) at a location that satisfies the distance
20	20	requirements of Subsection (a) at the time the application for the
21	21	initial authorization for the operation of that facility at that
22	22	location is filed with the commission, provided that the
23	23	authorization is granted and maintained, regardless of whether a
24	24	single or multifamily residence, school, or place of worship is
25	25	subsequently built or put to use within 440 yards of the facility;
26	26	or
27	27	(3) that:
28	28	(A) uses a concrete crusher:
29	29	(i) in the manufacture of products that
30	30	contain recycled materials; and
31	31	(ii) that is located in an enclosed
32	32	building; and
33	33	(B) is located:
34	34	(i) within 25 miles of an international
35	35	border; and
36	36	(ii) in a municipality with a population of
37	37	not less than 6,100 but not more than 20,000.
38	38	SECTION 2. This Act takes effect September 1, 2011.
