1010 relating to applications for appeal filed with an appellate court.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subsection (b), Section 51.005, Government Code,
1313 is amended to read as follows:
1414 (b) The fees are:
1515 (1) application for petition for review [writ of
1616 error]$ 50
1717 (2) additional fee if application for petition for
1818 review [writ of error] is granted$ 75
1919 (3) motion for leave to file petition for writ of
2020 mandamus, prohibition, injunction, and other similar proceedings
2121 originating in the supreme court$ 50
2222 (4) additional fee if a motion under Subdivision (3)
2323 is granted$ 75
2424 (5) certified question from a federal court of appeals
2525 to the supreme court$ 75
2626 (6) case appealed to the supreme court from the
2727 district court by direct appeal$100
2828 (7) any other proceeding filed in the supreme
2929 court$ 75.
3030 SECTION 2. Subsection (a), Section 51.207, Government Code,
3131 is amended to read as follows:
3232 (a) The clerk of a court of appeals shall collect the fees
3333 described in Subsection (b) in a civil case before the court for the
3434 following services:
3535 (1) filing records, applications, motions, briefs,
3636 and other necessary and proper papers;
3737 (2) docketing and making docket and minute book
3838 entries;
3939 (3) issuing notices, citations, processes, and
4040 mandates;
4141 (4) preparing transcripts on application for petition
4242 for review [writ of error] to the supreme court; and
4343 (5) performing other necessary clerical duties.
4444 SECTION 3. Section 101.021, Government Code, is amended to
4545 read as follows:
4646 Sec. 101.021. SUPREME COURT FEES AND COSTS: GOVERNMENT
4747 CODE. The clerk of the supreme court shall collect fees and costs
4848 as follows:
4949 (1) application for petition for review [writ of
5050 error] (Sec. 51.005, Government Code) . . . $50;
5151 (2) additional fee if application for petition for
5252 review [writ of error] is granted (Sec. 51.005, Government Code)
5353 . . . $75;
