| 7 | 7 | | relating to the use of bingo proceeds by licensed authorized |

| 8 | 8 | | organizations, including the use of proceeds to provide health |
|---|
| 9 | 9 | | insurance or health insurance benefits to certain employees. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2001.458, Occupations Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | Sec. 2001.458. ITEMS OF EXPENSE. (a) An item of expense |
|---|
| 14 | 14 | | may not be incurred or paid in connection with the conduct of bingo |
|---|
| 15 | 15 | | except an expense that is reasonable or necessary to conduct bingo, |
|---|
| 16 | 16 | | including an expense for: |
|---|
| 17 | 17 | | (1) advertising, including the cost of printing bingo |
|---|
| 18 | 18 | | gift certificates; |
|---|
| 19 | 19 | | (2) security; |
|---|
| 20 | 20 | | (3) repairs to premises and equipment; |
|---|
| 21 | 21 | | (4) bingo supplies and equipment; |
|---|
| 22 | 22 | | (5) prizes; |
|---|
| 23 | 23 | | (6) stated rental or mortgage and insurance expenses; |
|---|
| 24 | 24 | | (7) bookkeeping, legal, or accounting services |
|---|
| 25 | 25 | | related to bingo; |
|---|
| 26 | 26 | | (8) fees for bingo chairpersons, operators, managers, |
|---|
| 27 | 27 | | salespersons, callers, cashiers, ushers, janitorial services, and |
|---|
| 28 | 28 | | utility supplies and services; |
|---|
| 29 | 29 | | (9) health insurance or health insurance benefits for |
|---|
| 30 | 30 | | bingo chairpersons, operators, managers, salespersons, callers, |
|---|
| 31 | 31 | | cashiers, and ushers, as provided by Subsection (b); |
|---|
| 32 | 32 | | (10) license fees; |
|---|
| 33 | 33 | | (11) [(10)] attending a bingo seminar or convention |
|---|
| 34 | 34 | | required under Section 2001.107; and |
|---|
| 35 | 35 | | (12) [(11)] debit card transaction fees and electronic |
|---|
| 36 | 36 | | funds transfer fees. |
|---|
| 37 | 37 | | (b) The value of health insurance or [a] health insurance |
|---|
| 38 | 38 | | benefits [benefit] provided by a licensed authorized organization |
|---|
| 39 | 39 | | to an employee may not exceed 50 percent of the total premium owed |
|---|
| 40 | 40 | | [is not included under Subsection (a)(8)]. If an employee is |
|---|
| 41 | 41 | | employed by more than one licensed authorized organization, the |
|---|
| 42 | 42 | | combined value of health insurance or health insurance benefits |
|---|
| 43 | 43 | | provided to the employee by the employing organizations may not |
|---|
| 44 | 44 | | exceed 50 percent of the total premium owed. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect September 1, 2011. |
