66 AN ACT
77 relating to the use of bingo proceeds by licensed authorized
88 organizations, including the use of proceeds to provide health
99 insurance or health insurance benefits to certain employees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2001.458, Occupations Code, is amended
1212 to read as follows:
1313 Sec. 2001.458. ITEMS OF EXPENSE. (a) An item of expense
1414 may not be incurred or paid in connection with the conduct of bingo
1515 except an expense that is reasonable or necessary to conduct bingo,
1616 including an expense for:
1717 (1) advertising, including the cost of printing bingo
1818 gift certificates;
1919 (2) security;
2020 (3) repairs to premises and equipment;
2121 (4) bingo supplies and equipment;
2222 (5) prizes;
2323 (6) stated rental or mortgage and insurance expenses;
2424 (7) bookkeeping, legal, or accounting services
2525 related to bingo;
2626 (8) fees for bingo chairpersons, operators, managers,
2727 salespersons, callers, cashiers, ushers, janitorial services, and
2828 utility supplies and services;
2929 (9) health insurance or health insurance benefits for
3030 bingo chairpersons, operators, managers, salespersons, callers,
3131 cashiers, and ushers, as provided by Subsection (b);
3232 (10) license fees;
3333 (11) [(10)] attending a bingo seminar or convention
3434 required under Section 2001.107; and
3535 (12) [(11)] debit card transaction fees and electronic
3636 funds transfer fees.
3737 (b) The value of health insurance or [a] health insurance
3838 benefits [benefit] provided by a licensed authorized organization
3939 to an employee may not exceed 50 percent of the total premium owed
4040 [is not included under Subsection (a)(8)]. If an employee is
4141 employed by more than one licensed authorized organization, the
4242 combined value of health insurance or health insurance benefits
4343 provided to the employee by the employing organizations may not
4444 exceed 50 percent of the total premium owed.
4545 SECTION 2. This Act takes effect September 1, 2011.
