7	7	relating to reporting student enrollment in tech-prep programs and
8	8	evaluating tech-prep consortia.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 29.185, Education Code, is amended to
11	11	read as follows:
12	12	Sec. 29.185. CAREER AND TECHNOLOGY PROGRAM REQUIREMENTS AND
13	13	PROCEDURES [RULES]. (a) The agency shall prescribe requirements
14	14	for career and technology education in public schools as necessary
15	15	to comply with federal law.
16	16	(b) The agency shall establish procedures for each school
17	17	district and open-enrollment charter school to:
18	18	(1) accurately identify students who are enrolled in a
19	19	tech-prep program as described by Section 61.852; and
20	20	(2) report the accurate number of tech-prep program
21	21	students to the agency and the Texas Higher Education Coordinating
22	22	Board.
23	23	SECTION 2. Section 61.858, Education Code, is amended to
24	24	read as follows:
25	25	Sec. 61.858. TECH-PREP CONSORTIUM [STATEWIDE] EVALUATION.
26	26	(a) The [In coordination with tech-prep consortia, including the
27	27	governing board of each tech-prep consortium, the] board shall
28	28	develop and implement a statewide system to evaluate each tech-prep
29	29	consortium. The evaluation must include:
30	30	(1) an assessment of the consortium's performance
31	31	during the past year in comparison to the goals and objectives
32	32	stated in the five-year plan contained in the consortium's grant
33	33	application to the board under Section 61.856;
34	34	(2) an identification of any concerns the board has
35	35	regarding the consortium's performance; and
36	36	(3) recommendations for improvement by the consortium
37	37	in the next year [based on the success of the consortium's tech-prep
38	38	program and other appropriate criteria. The evaluation system must
39	39	include standards that a tech-prep consortium, including the
40	40	consortium's governing board, is expected to meet in administering
41	41	the consortium's duties under this subchapter].
42	42	(b) The [Using the criteria developed under Subsection (a),
43	43	the] board shall evaluate each tech-prep consortium annually
44	44	[biennially]. At least once every four years, or more frequently as
45	45	provided by board rule, the annual evaluation shall be conducted
46	46	on-site.
47	47	(c) Not later than November [October] 1 of each
48	48	[even-numbered] year, the board shall provide a written report to
49	49	each tech-prep consortium with the results of the evaluation. The
50	50	report must:
51	51	(1) contain the findings, concerns, and
52	52	recommendations resulting from the evaluation required under
53	53	Subsections (a) and (b);
54	54	(2) communicate to the consortium the results of the
55	55	board's evaluation, specifically including the elements required
56	56	by Subsection (a);
57	57	(3) [discuss any failure of the tech-prep consortium
58	58	to meet a standard established under Subsection (a) during the
59	59	reporting period, recognize the achievements of the consortium,
60	60	including the consortium's meeting of standards during the
61	61	reporting period,] identify areas in which the consortium has made
62	62	improvement or should take steps to improve its performance;[,] and
63	63	(4) identify best practices of tech-prep consortia.
64	64	SECTION 3. This Act takes effect September 1, 2011.
