11 | 11 | | persons; providing a penalty and other civil consequences. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Chapter 20A, Penal Code, is amended by adding |
---|
14 | 14 | | Section 20A.03 to read as follows: |
---|
15 | 15 | | Sec. 20A.03. CONTINUOUS TRAFFICKING OF PERSONS. (a) A |
---|
16 | 16 | | person commits an offense if, during a period that is 30 or more |
---|
17 | 17 | | days in duration, the person engages two or more times in conduct |
---|
18 | 18 | | that constitutes an offense under Section 20A.02. |
---|
19 | 19 | | (b) If a jury is the trier of fact, members of the jury are |
---|
20 | 20 | | not required to agree unanimously on which specific conduct engaged |
---|
21 | 21 | | in by the defendant constituted an offense under Section 20A.02 or |
---|
22 | 22 | | on which exact date the defendant engaged in that conduct. The jury |
---|
23 | 23 | | must agree unanimously that the defendant, during a period that is |
---|
24 | 24 | | 30 or more days in duration, engaged in conduct that constituted an |
---|
25 | 25 | | offense under Section 20A.02. |
---|
26 | 26 | | (c) If the victim of an offense under Subsection (a) is the |
---|
27 | 27 | | same victim as a victim of an offense under Section 20A.02, a |
---|
28 | 28 | | defendant may not be convicted of the offense under Section 20A.02 |
---|
29 | 29 | | in the same criminal action as the offense under Subsection (a), |
---|
30 | 30 | | unless the offense under Section 20A.02: |
---|
31 | 31 | | (1) is charged in the alternative; |
---|
32 | 32 | | (2) occurred outside the period in which the offense |
---|
33 | 33 | | alleged under Subsection (a) was committed; or |
---|
34 | 34 | | (3) is considered by the trier of fact to be a lesser |
---|
35 | 35 | | included offense of the offense alleged under Subsection (a). |
---|
36 | 36 | | (d) A defendant may not be charged with more than one count |
---|
37 | 37 | | under Subsection (a) if all of the conduct that constitutes an |
---|
38 | 38 | | offense under Section 20A.02 is alleged to have been committed |
---|
39 | 39 | | against the same victim. |
---|
40 | 40 | | (e) An offense under this section is a felony of the first |
---|
41 | 41 | | degree, punishable by imprisonment in the Texas Department of |
---|
42 | 42 | | Criminal Justice for life or for any term of not more than 99 years |
---|
43 | 43 | | or less than 25 years. |
---|
44 | 44 | | SECTION 2. Article 12.01, Code of Criminal Procedure, is |
---|
45 | 45 | | amended to read as follows: |
---|
46 | 46 | | Art. 12.01. FELONIES. Except as provided in Article 12.03, |
---|
47 | 47 | | felony indictments may be presented within these limits, and not |
---|
48 | 48 | | afterward: |
---|
49 | 49 | | (1) no limitation: |
---|
50 | 50 | | (A) murder and manslaughter; |
---|
51 | 51 | | (B) sexual assault under Section 22.011(a)(2), |
---|
52 | 52 | | Penal Code, or aggravated sexual assault under Section |
---|
53 | 53 | | 22.021(a)(1)(B), Penal Code; |
---|
54 | 54 | | (C) sexual assault, if during the investigation |
---|
55 | 55 | | of the offense biological matter is collected and subjected to |

58 | 58 | | readily ascertained; |
---|
59 | 59 | | (D) continuous sexual abuse of young child or |

60 | 60 | | children under Section 21.02, Penal Code; |

61 | 61 | | (E) indecency with a child under Section 21.11, |
---|
62 | 62 | | Penal Code; [or] |
---|
63 | 63 | | (F) an offense involving leaving the scene of an |
---|
64 | 64 | | accident under Section 550.021, Transportation Code, if the |
---|
65 | 65 | | accident resulted in the death of a person; or |
---|
66 | 66 | | (G) continuous trafficking of persons under |
---|
67 | 67 | | Section 20A.03, Penal Code; |
---|
68 | 68 | | (2) ten years from the date of the commission of the |
---|
69 | 69 | | offense: |
---|
70 | 70 | | (A) theft of any estate, real, personal or mixed, |
---|
71 | 71 | | by an executor, administrator, guardian or trustee, with intent to |
---|
72 | 72 | | defraud any creditor, heir, legatee, ward, distributee, |
---|
73 | 73 | | beneficiary or settlor of a trust interested in such estate; |
---|
74 | 74 | | (B) theft by a public servant of government |
---|
75 | 75 | | property over which he exercises control in his official capacity; |
---|
76 | 76 | | (C) forgery or the uttering, using or passing of |
---|
77 | 77 | | forged instruments; |
---|
78 | 78 | | (D) injury to an elderly or disabled individual |
---|
79 | 79 | | punishable as a felony of the first degree under Section 22.04, |
---|
80 | 80 | | Penal Code; |
---|
81 | 81 | | (E) sexual assault, except as provided by |
---|
82 | 82 | | Subdivision (1); or |
---|
83 | 83 | | (F) arson; |
---|
84 | 84 | | (3) seven years from the date of the commission of the |
---|
85 | 85 | | offense: |
---|
86 | 86 | | (A) misapplication of fiduciary property or |
---|
87 | 87 | | property of a financial institution; |
---|
88 | 88 | | (B) securing execution of document by deception; |
---|
89 | 89 | | (C) a felony violation under Chapter 162, Tax |
---|
90 | 90 | | Code; |
---|
91 | 91 | | (D) false statement to obtain property or credit |
---|
92 | 92 | | under Section 32.32, Penal Code; |

108 | 108 | | (5) if the investigation of the offense shows that the |

109 | 109 | | victim is younger than 17 years of age at the time the offense is |

110 | 110 | | committed, 20 years from the 18th birthday of the victim of one of |

111 | 111 | | the following offenses: |
---|
112 | 112 | | (A) sexual performance by a child under Section |
---|
113 | 113 | | 43.25, Penal Code; |
---|
114 | 114 | | (B) aggravated kidnapping under Section |
---|
115 | 115 | | 20.04(a)(4), Penal Code, if the defendant committed the offense |
---|
116 | 116 | | with the intent to violate or abuse the victim sexually; or |
---|
117 | 117 | | (C) burglary under Section 30.02, Penal Code, if |
---|
118 | 118 | | the offense is punishable under Subsection (d) of that section and |
---|
119 | 119 | | the defendant committed the offense with the intent to commit an |
---|
120 | 120 | | offense described by Subdivision (1)(B) or (D) of this article or |
---|
121 | 121 | | Paragraph (B) of this subdivision; |
---|
122 | 122 | | (6) ten years from the 18th birthday of the victim of |
---|
123 | 123 | | the offense: injury to a child under Section 22.04, Penal Code; or |
---|
124 | 124 | | (7) three years from the date of the commission of the |
---|
125 | 125 | | offense: all other felonies. |
---|
126 | 126 | | SECTION 3. Subsection (b), Article 17.03, Code of Criminal |
---|
127 | 127 | | Procedure, is amended to read as follows: |
---|
128 | 128 | | (b) Only the court before whom the case is pending may |
---|
129 | 129 | | release on personal bond a defendant who: |
---|
130 | 130 | | (1) is charged with an offense under the following |

158 | 158 | | SECTION 4. Subsection (a), Article 17.032, Code of Criminal |

181 | 181 | | Before a judge or magistrate reduces the amount of bail set for a |

308 | 308 | | SECTION 9. Section 508.046, Government Code, is amended to |
---|
309 | 309 | | read as follows: |
---|
310 | 310 | | Sec. 508.046. EXTRAORDINARY VOTE REQUIRED. To release on |
---|
311 | 311 | | parole an inmate who was convicted of an offense under Section |
---|
312 | 312 | | 20A.03, 21.02, 21.11(a)(1), or 22.021, Penal Code, or who is |
---|
313 | 313 | | required under Section 508.145(c) to serve 35 calendar years before |
---|
314 | 314 | | becoming eligible for release on parole, all members of the board |
---|
315 | 315 | | must vote on the release on parole of the inmate, and at least |
---|
316 | 316 | | two-thirds of the members must vote in favor of the release on |
---|
317 | 317 | | parole. A member of the board may not vote on the release unless the |
---|
318 | 318 | | member first receives a copy of a written report from the department |
---|
319 | 319 | | on the probability that the inmate would commit an offense after |

320 | 320 | | being released on parole. |
---|
321 | 321 | | SECTION 10. Subsection (d), Section 508.145, Government |
---|
322 | 322 | | Code, is amended to read as follows: |

323 | 323 | | (d) An inmate serving a sentence for an offense described by |
---|
324 | 324 | | Section 3g(a)(1)(A), (C), (D), (E), (F), (G), (H), (I), (J), or (K), |

325 | 325 | | Article 42.12, Code of Criminal Procedure, or for an offense for |
---|
326 | 326 | | which the judgment contains an affirmative finding under Section |
---|
327 | 327 | | 3g(a)(2) of that article, or for an offense under Section 20A.03, |

328 | 328 | | Penal Code, is not eligible for release on parole until the inmate's |
---|
329 | 329 | | actual calendar time served, without consideration of good conduct |

---|
332 | 332 | | release on parole in less than two calendar years. |
