99 AN ACT
1010 relating to energy savings performance contracts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 44.901, Education Code, is amended by
1313 amending Subsection (a) and adding Subsection (f-1) to read as
1414 follows:
1515 (a) In this section, "energy savings performance contract"
1616 means a contract for energy or water conservation measures to
1717 reduce energy or water consumption or operating costs of new or
1818 existing school facilities in which the estimated savings in
1919 utility costs resulting from the measures is guaranteed to offset
2020 the cost of the measures over a specified period. The term includes
2121 a contract for the installation or implementation of:
2222 (1) insulation of a building structure and systems
2323 within the building;
2424 (2) storm windows or doors, caulking or
2525 weatherstripping, multiglazed windows or doors, heat absorbing or
2626 heat reflective glazed and coated window or door systems, or other
2727 window or door system modifications that reduce energy consumption;
2828 (3) automatic energy control systems, including
2929 computer software and technical data licenses;
3030 (4) heating, ventilating, or air-conditioning system
3131 modifications or replacements that reduce energy or water
3232 consumption;
3333 (5) lighting fixtures that increase energy
3434 efficiency;
3535 (6) energy recovery systems;
3636 (7) electric systems improvements;
3737 (8) water-conserving fixtures, appliances, and
3838 equipment or the substitution of non-water-using fixtures,
3939 appliances, and equipment;
4040 (9) water-conserving landscape irrigation equipment;
4141 (10) landscaping measures that reduce watering
4242 demands and capture and hold applied water and rainfall, including:
4343 (A) landscape contouring, including the use of
4444 berms, swales, and terraces; and
4545 (B) the use of soil amendments that increase the
4646 water-holding capacity of the soil, including compost;
4747 (11) rainwater harvesting equipment and equipment to
4848 make use of water collected as part of a storm-water system
4949 installed for water quality control;
5050 (12) equipment for recycling or reuse of water
5151 originating on the premises or from other sources, including
5252 treated municipal effluent;
5353 (13) equipment needed to capture water from
5454 nonconventional, alternate sources, including air conditioning
5555 condensate or graywater, for nonpotable uses;
5656 (14) metering equipment needed to segregate water use
5757 in order to identify water conservation opportunities or verify
5858 water savings; or
5959 (15) other energy or water conservation-related
6060 improvements or equipment, including improvements or equipment
6161 relating to renewable energy or nonconventional water sources or
6262 water reuse.
6363 (f-1) Notwithstanding other law, the board of trustees of a
6464 school district may use any available money, other than money
6565 borrowed from this state, to pay the provider of the energy or water
6666 conservation measures under this section, and the board is not
6767 required to pay for the energy or water conservation measures
6868 solely out of the savings realized by the school district under an
6969 energy savings performance contract.
7070 SECTION 2. Section 51.927, Education Code, is amended by
7171 amending Subsection (a) and adding Subsection (g-1) to read as
7272 follows:
7373 (a) In this section, "energy savings performance contract"
7474 means a contract for energy or water conservation measures to
7575 reduce energy or water consumption or operating costs of new or
7676 existing institutional facilities in which the estimated savings in
7777 utility costs resulting from the measures is guaranteed to offset
7878 the cost of the measures over a specified period. The term includes
7979 a contract for the installation or implementation of:
8080 (1) insulation of a building structure and systems
8181 within a building;
8282 (2) storm windows or doors, caulking or weather
8383 stripping, multiglazed windows or doors, heat-absorbing or
8484 heat-reflective glazed and coated window or door systems, or other
8585 window or door system modifications that reduce energy consumption;
8686 (3) automatic energy control systems, including
8787 computer software and technical data licenses;
8888 (4) heating, ventilating, or air conditioning system
8989 modifications or replacements that reduce energy or water
9090 consumption;
9191 (5) lighting fixtures that increase energy
9292 efficiency;
9393 (6) energy recovery systems;
9494 (7) electric systems improvements;
9595 (8) water-conserving fixtures, appliances, and
9696 equipment or the substitution of non-water-using fixtures,
9797 appliances, and equipment;
9898 (9) water-conserving landscape irrigation equipment;
9999 (10) landscaping measures that reduce watering
100100 demands and capture and hold applied water and rainfall, including:
101101 (A) landscape contouring, including the use of
102102 berms, swales, and terraces; and
103103 (B) the use of soil amendments that increase the
104104 water-holding capacity of the soil, including compost;
105105 (11) rainwater harvesting equipment and equipment to
106106 make use of water collected as part of a storm-water system
107107 installed for water quality control;
108108 (12) equipment for recycling or reuse of water
109109 originating on the premises or from other sources, including
110110 treated municipal effluent;
111111 (13) equipment needed to capture water from
112112 nonconventional, alternate sources, including air conditioning
113113 condensate or graywater, for nonpotable uses;
114114 (14) metering equipment needed to segregate water use
115115 in order to identify water conservation opportunities or verify
116116 water savings; or
117117 (15) other energy or water conservation-related
118118 improvements or equipment, including improvements or equipment
119119 related to renewable energy or nonconventional water sources or
120120 water reuse.
121121 (g-1) Notwithstanding other law, the board may use any
122122 available money, other than money borrowed from this state, to pay
123123 the provider of the energy or water conservation measures under
124124 this section, and the board is not required to pay for the energy or
125125 water conservation measures solely out of the savings realized by
126126 the institution of higher education under an energy savings
127127 performance contract.
128128 SECTION 3. Section 2166.406, Government Code, is amended by
129129 amending Subsections (a) and (g) and adding Subsection (f-1) to
130130 read as follows:
131131 (a) In this section, "energy savings performance contract"
132132 means a contract for energy or water conservation measures to
133133 reduce energy or water consumption or operating costs of new or
134134 existing governmental facilities in which the estimated savings in
135135 utility costs resulting from the measures is guaranteed to offset
136136 the cost of the measures over a specified period. The term includes
137137 a contract for the installation of:
138138 (1) insulation of a building structure and systems
139139 within the building;
140140 (2) storm windows or doors, caulking or weather
141141 stripping, multiglazed windows or doors, heat absorbing or heat
142142 reflective glazed and coated window or door systems, or other
143143 window or door system modifications that reduce energy consumption;
144144 (3) automatic energy control systems, including
145145 computer software and technical data licenses;
146146 (4) heating, ventilating, or air-conditioning system
147147 modifications or replacements that reduce energy or water
148148 consumption;
149149 (5) lighting fixtures that increase energy
150150 efficiency;
151151 (6) energy recovery systems;

159159 (A) landscape contouring, including the use of
160160 berms, swales, and terraces; and
161161 (B) the use of soil amendments that increase the
162162 water-holding capacity of the soil, including compost;
163163 (11) rainwater harvesting equipment and equipment to
164164 make use of water collected as part of a storm-water system
165165 installed for water quality control;
166166 (12) equipment for recycling or reuse of water
167167 originating on the premises or from other sources, including
168168 treated municipal effluent;
169169 (13) equipment needed to capture water from
170170 nonconventional, alternate sources, including air conditioning
171171 condensate or graywater, for nonpotable uses;
172172 (14) metering equipment needed to segregate water use
173173 in order to identify water conservation opportunities or verify
174174 water savings; or
175175 (15) other energy or water conservation-related
176176 improvements or equipment including improvements or equipment
177177 related to renewable energy or nonconventional water sources or
178178 water reuse.
179179 (f-1) Notwithstanding other law, the state agency may use
180180 any available money, other than money borrowed from this state, to
181181 pay the provider of the energy or water conservation measures under
182182 this section, and the state agency is not required to pay for energy
183183 or water conservation measures solely out of the savings realized
184184 by the state agency under an energy savings performance contract.
185185 (g) An energy savings performance contract with respect to
186186 [existing] buildings or facilities may be financed:
187187 (1) under a lease/purchase contract that has a term
188188 not to exceed 20 years from the final date of installation and that
189189 meets federal tax requirements for tax-free municipal leasing or
190190 long-term financing, including a lease/purchase contract under the
191191 master equipment lease purchase program administered by the Texas
192192 Public Finance Authority under Chapter 1232;
193193 (2) with the proceeds of bonds; or
194194 (3) under a contract with the provider of the energy or
195195 water conservation measures that has a term not to exceed the lesser
196196 of 20 years from the final date of installation or the average
197197 useful life of the energy or water conservation or usage measures.
198198 SECTION 4. Subdivision (4), Section 302.001, Local
199199 Government Code, is amended to read as follows:
200200 (4) "Energy savings performance contract" means a
201201 contract between a local government and a provider for energy or
202202 water conservation or usage measures in which the estimated energy
203203 savings, increase in billable revenues, or increase in meter
204204 accuracy resulting from the measures is subject to guarantee to
205205 offset the cost of the energy or water conservation or usage
206206 measures over a specified period. The term includes a contract for
207207 the installation or implementation of the following in new or
208208 existing facilities, including all causally connected work:
209209 (A) insulation of a building structure and
210210 systems within the building;
211211 (B) storm windows or doors, caulking or weather
212212 stripping, multiglazed windows or doors, heat-absorbing or
213213 heat-reflective glazed and coated window or door systems, or other
214214 window or door system modifications that reduce energy consumption;
215215 (C) automatic energy control systems, including
216216 computer software and technical data licenses;
217217 (D) heating, ventilating, or air-conditioning
218218 system modifications or replacements that reduce energy or water
219219 consumption;
220220 (E) lighting fixtures that increase energy
221221 efficiency;
222222 (F) energy recovery systems;
223223 (G) electric systems improvements;
224224 (H) water-conserving fixtures, appliances, and
225225 equipment or the substitution of non-water-using fixtures,
226226 appliances, and equipment;
227227 (I) water-conserving landscape irrigation
228228 equipment;
229229 (J) landscaping measures that reduce watering
230230 demands and capture and hold applied water and rainfall, including:
231231 (i) landscape contouring, including the use
232232 of berms, swales, and terraces; and
233233 (ii) the use of soil amendments that
234234 increase the water-holding capacity of the soil, including compost;
235235 (K) rainwater harvesting equipment and equipment
236236 to make use of water collected as part of a storm-water system
237237 installed for water quality control;
238238 (L) equipment for recycling or reuse of water
239239 originating on the premises or from other sources, including
240240 treated municipal effluent;
241241 (M) equipment needed to capture water from
242242 nonconventional, alternate sources, including air-conditioning
243243 condensate or graywater, for nonpotable uses;
244244 (N) metering or related equipment or systems that
245245 improve the accuracy of billable-revenue-generation systems; or
246246 (O) other energy or water conservation-related
247247 improvements or equipment, including improvements or equipment
248248 relating to renewable energy or nonconventional water sources or
249249 water reuse.
250250 SECTION 5. Section 302.004, Local Government Code, is
251251 amended by adding Subsection (a-1) to read as follows:
252252 (a-1) Notwithstanding other law, the governing body of a
253253 local government may use any available money, other than money
254254 borrowed from this state, to pay the provider of the energy or water
255255 conservation measures under this section, and the governing body is
256256 not required to pay for energy or water conservation measures
257257 solely out of the savings realized by the local government under an
258258 energy savings performance contract.
259259 SECTION 6. This Act takes effect September 1, 2011.
