1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to license renewals by the Texas Department of Licensing
1313 and Regulation.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subsections (c) and (d), Section 51.401,
1616 Occupations Code, are amended to read as follows:
1717 (c) A person whose license has been expired for more than 90
1818 days but less than 18 months [one year] may renew the license by
1919 paying to the department a renewal fee that is equal to two times
2020 the normally required renewal fee. On approval by the executive
2121 director, a person whose license has been expired for at least 18
2222 months but less than three years may renew the license by paying to
2323 the department a renewal fee equal to two times the normally
2424 required renewal fee.
2525 (d) Except as provided by Subsection (c), a [A] person whose
2626 license has been expired for 18 months [one year] or more may not
2727 renew the license. The person may obtain a new license by complying
2828 with the requirements and procedures, including the examination
2929 requirements, for obtaining an original license.
3030 SECTION 2. The changes in law made by this Act apply only to
3131 an application for the renewal of a license that is filed with the
3232 Texas Department of Licensing and Regulation on or after the
3333 effective date of this Act. An application for the renewal of a
3434 license that is filed before the effective date of this Act is
3535 governed by the law in effect on the date the application was filed,
3636 and the former law is continued in effect for that purpose.
3737 SECTION 3. This Act takes effect September 1, 2011.
