10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subsection (k), Section 22.004, Education Code, | |
12 | 12 | is amended to read as follows: | |
13 | 13 | (k) Notwithstanding any other law, an employee of a district | |
14 | 14 | participating in the uniform group coverage program under | |
15 | 15 | Subsection (a) or providing group health coverage under Subsection | |
16 | 16 | (b) whose resignation is effective after the last day of an | |
17 | 17 | instructional year is entitled to participate or be enrolled in the | |
18 | 18 | uniform group coverage plan or the group health coverage through | |
19 | 19 | the earlier of: | |
20 | 20 | (1) the first anniversary of the date participation in | |
21 | 21 | or coverage under the uniform group coverage plan or the group | |
22 | 22 | health coverage was first made available to district employees for | |
23 | 23 | the last instructional year in which the employee was employed by | |
24 | 24 | the district; or | |
25 | 25 | (2) the last calendar day before the first day of the | |
26 | 26 | instructional year immediately following the last instructional | |
27 | 27 | year in which the employee was employed by the district. | |
28 | 28 | SECTION 2. The change in law made by this Act applies | |
29 | 29 | beginning with the 2012-2013 school year. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2011. |
