| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (a-2), Section 28.009, Education |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | (a-2) A school district is not required to pay a student's |
|---|
| 13 | 13 | | tuition or other associated costs for taking a course under this |
|---|
| 14 | 14 | | section. This subsection expires September 1, 2013 [2011]. |

| 15 | 15 | | SECTION 2. Subsection (g), Section 42.005, Education Code, |
|---|
| 16 | 16 | | as effective September 1, 2011, is amended to read as follows: |
|---|
| 17 | 17 | | (g) If a student may receive course credit toward the |
|---|
| 18 | 18 | | student's high school academic requirements and toward the |
|---|
| 19 | 19 | | student's higher education academic requirements for a single |
|---|
| 20 | 20 | | course, including a course provided under Section 28.009 by a |
|---|
| 21 | 21 | | public institution of higher education, the time during which the |
|---|
| 22 | 22 | | student attends the course shall be counted as part of the minimum |
|---|
| 23 | 23 | | number of instructional hours required for a student to be |
|---|
| 24 | 24 | | considered a full-time student in average daily attendance for |
|---|
| 25 | 25 | | purposes of this section. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect August 31, 2011. |
