A BILL TO BE ENTITLED
AN ACT
relating to the use of a mobile tracking device without a court
order in the course of a criminal investigation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 14, Article 18.21, Code of Criminal
Procedure, is amended by adding Subsection (h) to read as follows:
(h) This section does not prohibit the installation and use
of a mobile tracking device without an order in the course of a
criminal investigation if an order is not required under the Texas
Constitution or United States Constitution.
SECTION 2. This Act takes effect September 1, 2011.
