| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter E, Chapter 223, Transportation Code, | |
| 11 | 11 | is amended by adding Section 223.2012 to read as follows: | |
| 12 | 12 | Sec. 223.2012. NO EFFECT ON DEPARTMENT OBLIGATIONS. Any | |
| 13 | 13 | authority for the department to enter into a comprehensive | |
| 14 | 14 | development agreement relating to improvements to Grand Parkway | |
| 15 | 15 | (State Highway 99) does not affect the obligation of the department | |
| 16 | 16 | to comply with the applicable requirements of an agreement entered | |
| 17 | 17 | into under Section 228.0111 in connection with the Grand Parkway | |
| 18 | 18 | project, including complying with the terms and conditions for the | |
| 19 | 19 | development, construction, and operation of the Grand Parkway that | |
| 20 | 20 | are prescribed in such an agreement. | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2011. |
