1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to a fixed tuition rate program for certain students who
1313 transfer to a state university after completing an associate degree
1414 program.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subchapter A, Chapter 54, Education Code, is
1717 amended by adding Section 54.016 to read as follows:
1818 Sec. 54.016. FIXED TUITION RATE PROGRAM FOR CERTAIN
1919 TRANSFER STUDENTS AT GENERAL ACADEMIC TEACHING INSTITUTIONS.
2020 (a) In this section:
2121 (1) "Coordinating board" means the Texas Higher
2222 Education Coordinating Board.
2323 (2) "General academic teaching institution" has the
2424 meaning assigned by Section 61.003.
2525 (3) "Lower-division institution of higher education"
2626 means a public junior college, public state college, or public
2727 technical institute.
2828 (b) A general academic teaching institution may develop a
2929 fixed tuition rate program for qualified students who agree to
3030 transfer to the institution within 12 months after successfully
3131 earning an associate degree at a lower-division institution of
3232 higher education. Under a program developed under this section, a
3333 general academic teaching institution must:
3434 (1) guarantee to a participating student enrolled in
3535 an associate degree program at a lower-division institution of
3636 higher education, on successful completion of the associate degree
3737 program, transfer admission to the general academic teaching
3838 institution within the period prescribed above; and
3939 (2) notwithstanding any other provision of this
4040 chapter, charge tuition to a participating student for any semester
4141 or other academic term at the same rate the general academic
4242 teaching institution would have charged to the student during the
4343 later of:
4444 (A) the fall semester of the student's freshman
4545 year at another institution of higher education had the student
4646 entered the general academic teaching institution as a freshman
4747 student; or
4848 (B) the fall semester of the second academic year
4949 preceding the academic year of the student's initial enrollment in
5050 the general academic teaching institution.
5151 (c) A general academic teaching institution that develops a
5252 fixed tuition rate program under this section shall prescribe
5353 eligibility requirements for participation in the program and
5454 notify applicants for transfer admission from lower-division
5555 institutions of higher education regarding the program.
5656 SECTION 2. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2011.
