11	11	AN ACT
12	12	relating to a fixed tuition rate program for certain students who
13	13	transfer to a state university after completing an associate degree
14	14	program.
15	15	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	16	SECTION 1. Subchapter A, Chapter 54, Education Code, is
17	17	amended by adding Section 54.016 to read as follows:
18	18	Sec. 54.016. FIXED TUITION RATE PROGRAM FOR CERTAIN
19	19	TRANSFER STUDENTS AT GENERAL ACADEMIC TEACHING INSTITUTIONS.
20	20	(a) In this section:
21	21	(1) "Coordinating board" means the Texas Higher
22	22	Education Coordinating Board.
23	23	(2) "General academic teaching institution" has the
24	24	meaning assigned by Section 61.003.
25	25	(3) "Lower-division institution of higher education"
26	26	means a public junior college, public state college, or public
27	27	technical institute.
28	28	(b) A general academic teaching institution may develop a
29	29	fixed tuition rate program for qualified students who agree to
30	30	transfer to the institution within 12 months after successfully
31	31	earning an associate degree at a lower-division institution of
32	32	higher education. Under a program developed under this section, a
33	33	general academic teaching institution must:
34	34	(1) guarantee to a participating student enrolled in
35	35	an associate degree program at a lower-division institution of
36	36	higher education, on successful completion of the associate degree
37	37	program, transfer admission to the general academic teaching
38	38	institution within the period prescribed above; and
39	39	(2) notwithstanding any other provision of this
40	40	chapter, charge tuition to a participating student for any semester
41	41	or other academic term at the same rate the general academic
42	42	teaching institution would have charged to the student during the
43	43	later of:
44	44	(A) the fall semester of the student's freshman
45	45	year at another institution of higher education had the student
46	46	entered the general academic teaching institution as a freshman
47	47	student; or
48	48	(B) the fall semester of the second academic year
49	49	preceding the academic year of the student's initial enrollment in
50	50	the general academic teaching institution.
51	51	(c) A general academic teaching institution that develops a
52	52	fixed tuition rate program under this section shall prescribe
53	53	eligibility requirements for participation in the program and
54	54	notify applicants for transfer admission from lower-division
55	55	institutions of higher education regarding the program.
56	56	SECTION 2. This Act takes effect immediately if it receives
57	57	a vote of two-thirds of all the members elected to each house, as
58	58	provided by Section 39, Article III, Texas Constitution. If this
59	59	Act does not receive the vote necessary for immediate effect, this
60	60	Act takes effect September 1, 2011.
