88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subsection (c), Section 434.017, Government
1010 Code, is amended to read as follows:
1111 (c) Money in the fund may only be appropriated to the Texas
1212 Veterans Commission. Money appropriated under this subsection
1313 shall be used to:
1414 (1) [enhance or improve veterans' assistance programs,
1515 including veterans' representation and counseling;
1616 [(2)] make grants to address veterans' needs; and
1717 (2) [(3)] administer the fund.
1818 SECTION 2. Subsections (a) and (e), Section 434.017,
1919 Government Code, as amended by Chapters 840 (S.B. 1940) and 1385
2020 (S.B. 1655), Acts of the 81st Legislature, Regular Session, 2009,
2121 are reenacted and amended to read as follows:
2222 (a) The fund for veterans' assistance is a special fund in
2323 the state treasury outside the general revenue fund. The fund is
2424 composed of:
2525 (1) money transferred to the fund at the direction of
2626 the legislature;
2727 (2) gifts and grants contributed to the fund;
2828 (3) the earnings of the fund; [and]
2929 (4) money transferred to the fund from proceeds of the
3030 lottery game operated under Section 466.027 or transferred to the
3131 fund under Section 466.408(b); and
3232 (5) [(2)] money deposited to the credit of the fund
3333 under Section 502.1746, Transportation Code.
3434 (e) To carry out any purpose of this chapter, the commission
3535 [Texas Veterans Commission] may solicit, [and] accept, or refuse a
3636 gift, grant, devise, bequest of money, security, service, or
3737 property, including money raised or a service provided by a
3838 volunteer or volunteer group, to promote the work of the commission
3939 for any purpose related to the fund for veterans' assistance. The
4040 commission may participate in the establishment and operation of an
4141 affiliated nonprofit organization that is established for the
4242 purpose of raising money for or providing services or other
4343 benefits to the commission. A gift, grant, devise, or bequest to
4444 the fund may be appropriated in the same manner as other money in
4545 the fund, subject to the purposes provided by Subsection (c) and any
4646 limitation or requirement placed on the gift, grant, devise, or
4747 bequest by the donor or granting entity.
4848 SECTION 3. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2011.
