7 | 7 | | relating to the use of the fund for veterans' assistance. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subsection (c), Section 434.017, Government |
---|
10 | 10 | | Code, is amended to read as follows: |
---|
11 | 11 | | (c) Money in the fund may only be appropriated to the Texas |
---|
12 | 12 | | Veterans Commission. Money appropriated under this subsection |
---|
13 | 13 | | shall be used to: |
---|
14 | 14 | | (1) [enhance or improve veterans' assistance programs, |
---|
15 | 15 | | including veterans' representation and counseling; |
---|
16 | 16 | | [(2)] make grants to address veterans' needs; and |
---|
17 | 17 | | (2) [(3)] administer the fund. |
---|
18 | 18 | | SECTION 2. Subsections (a) and (e), Section 434.017, |
---|
19 | 19 | | Government Code, as amended by Chapters 840 (S.B. 1940) and 1385 |
---|
20 | 20 | | (S.B. 1655), Acts of the 81st Legislature, Regular Session, 2009, |
---|
21 | 21 | | are reenacted and amended to read as follows: |
---|
22 | 22 | | (a) The fund for veterans' assistance is a special fund in |
---|
23 | 23 | | the state treasury outside the general revenue fund. The fund is |
---|
24 | 24 | | composed of: |
---|
25 | 25 | | (1) money transferred to the fund at the direction of |
---|
26 | 26 | | the legislature; |
---|
27 | 27 | | (2) gifts and grants contributed to the fund; |
---|
28 | 28 | | (3) the earnings of the fund; [and] |
---|
29 | 29 | | (4) money transferred to the fund from proceeds of the |
---|
30 | 30 | | lottery game operated under Section 466.027 or transferred to the |
---|
31 | 31 | | fund under Section 466.408(b); and |
---|
32 | 32 | | (5) [(2)] money deposited to the credit of the fund |
---|
33 | 33 | | under Section 502.1746, Transportation Code. |
---|
34 | 34 | | (e) To carry out any purpose of this chapter, the commission |
---|
35 | 35 | | [Texas Veterans Commission] may solicit, [and] accept, or refuse a |
---|
36 | 36 | | gift, grant, devise, bequest of money, security, service, or |
---|
37 | 37 | | property, including money raised or a service provided by a |
---|
38 | 38 | | volunteer or volunteer group, to promote the work of the commission |
---|
39 | 39 | | for any purpose related to the fund for veterans' assistance. The |
---|
40 | 40 | | commission may participate in the establishment and operation of an |
---|
41 | 41 | | affiliated nonprofit organization that is established for the |
---|
42 | 42 | | purpose of raising money for or providing services or other |
---|
43 | 43 | | benefits to the commission. A gift, grant, devise, or bequest to |
---|
44 | 44 | | the fund may be appropriated in the same manner as other money in |
---|
45 | 45 | | the fund, subject to the purposes provided by Subsection (c) and any |
---|
46 | 46 | | limitation or requirement placed on the gift, grant, devise, or |
---|
47 | 47 | | bequest by the donor or granting entity. |
---|
48 | 48 | | SECTION 3. This Act takes effect immediately if it receives |
---|
49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
---|
50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
---|
52 | 52 | | Act takes effect September 1, 2011. |
