66 AN ACT
77 relating to calculation of the net resources of a person ordered to
88 pay child support.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 154.062, Family Code, is amended by
1111 amending Subsection (d) and adding Subsection (f) to read as
1212 follows:
1313 (d) The court shall deduct the following items from
1414 resources to determine the net resources available for child
1515 support:
1616 (1) social security taxes;
1717 (2) federal income tax based on the tax rate for a
1818 single person claiming one personal exemption and the standard
1919 deduction;
2020 (3) state income tax;
2121 (4) union dues; [and]
2222 (5) expenses for the cost of health insurance or cash
2323 medical support for the obligor's child ordered by the court under
2424 Section 154.182; and
2525 (6) if the obligor does not pay social security taxes,
2626 nondiscretionary retirement plan contributions.
2727 (f) For purposes of Subsection (d)(6), a nondiscretionary
2828 retirement plan is a plan to which an employee is required to
2929 contribute as a condition of employment.
3030 SECTION 2. The change in law made by this Act applies only
3131 to a proceeding to establish or modify a child support obligation
3232 that is pending in a trial court on or filed on or after the
3333 effective date of this Act.
3434 SECTION 3. This Act takes effect September 1, 2012.
