9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 154.062, Family Code, is amended by | |
11 | 11 | amending Subsection (d) and adding Subsection (f) to read as | |
12 | 12 | follows: | |
13 | 13 | (d) The court shall deduct the following items from | |
14 | 14 | resources to determine the net resources available for child | |
15 | 15 | support: | |
16 | 16 | (1) social security taxes; | |
17 | 17 | (2) federal income tax based on the tax rate for a | |
18 | 18 | single person claiming one personal exemption and the standard | |
19 | 19 | deduction; | |
20 | 20 | (3) state income tax; | |
21 | 21 | (4) union dues; [and] | |
22 | 22 | (5) expenses for the cost of health insurance or cash | |
23 | 23 | medical support for the obligor's child ordered by the court under | |
24 | 24 | Section 154.182; and | |
25 | 25 | (6) if the obligor does not pay social security taxes, | |
26 | 26 | nondiscretionary retirement plan contributions. | |
27 | 27 | (f) For purposes of Subsection (d)(6), a nondiscretionary | |
28 | 28 | retirement plan is a plan to which an employee is required to | |
29 | 29 | contribute as a condition of employment. | |
30 | 30 | SECTION 2. The change in law made by this Act applies only | |
31 | 31 | to a proceeding to establish or modify a child support obligation | |
32 | 32 | that is pending in a trial court on or filed on or after the | |
33 | 33 | effective date of this Act. | |
34 | 34 | SECTION 3. This Act takes effect September 1, 2012. |
