 A BILL TO BE ENTITLED
 AN ACT
 relating to the maintenance by certain hospitals of records
 regarding certain uncompensated care costs.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 311, Health and Safety
 Code, is amended by adding Section 311.034 to read as follows:
 Sec. 311.034.  RECORDS OF CERTAIN COSTS REQUIRED; REPORT.
 (a) A public or private hospital that receives trauma funds under
 Section 773.122, 780.004, or 782.003 or Section 403.106, Government
 Code, shall maintain a record of:
 (1)  the amount of uncompensated care costs at the
 hospital resulting from workplace injuries; and
 (2)  the cause of each workplace injury for which
 treatment is uncompensated or, if the cause is not known, the name
 of the employer of the injured person.
 (b)  A hospital described by Subsection (a) annually shall
 submit to the department a report containing the records required
 by that subsection.
 (c)  The department shall provide technical assistance to a
 hospital described by Subsection (a) to maximize the efficiency of
 reporting under this section.
 SECTION 2.  A hospital required to report to the Department
 of State Health Services under Section 311.034, Health and Safety
 Code, as added by this Act, shall submit the initial report required
 by that section not later than August 1, 2012.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
