 A BILL TO BE ENTITLED
 AN ACT
 relating to a warning notice posted outside of certain buildings
 that permit smoking; providing a penalty.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 161, Health and Safety Code, is amended
 by adding Subchapter O-1 to read as follows:
 SUBCHAPTER O-1.  SMOKING IN BUILDINGS
 Sec. 161.321.  DEFINITION.  In this subchapter, "smoke"
 means to inhale, exhale, burn, or carry a lighted cigar, cigarette,
 pipe, or other smoking equipment.
 Sec. 161.322.  WARNING NOTICE POSTED OUTSIDE BUILDING. An
 owner, operator, manager, or other person in control of a building
 that the public is invited or allowed to enter and in which smoking
 is permitted shall post clearly and conspicuously at each public
 entrance to the building a sign that reads: "WARNING: SMOKING IS
 PERMITTED INSIDE THIS BUILDING."
 Sec. 161.323.  OFFENSE.  A person who violates this
 subchapter commits an offense.  An offense under this section is a
 Class C misdemeanor.
 SECTION 2.  This Act takes effect September 1, 2011.
