| 7 | 7 | | relating to platting requirements affecting subdivision golf |

| 8 | 8 | | courses in certain counties. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (a), Section 212.0155, Local |
|---|
| 11 | 11 | | Government Code, is amended to read as follows: |
|---|
| 12 | 12 | | (a) This section applies to land located wholly or partly: |
|---|
| 13 | 13 | | (1) in the corporate boundaries of a municipality if |
|---|
| 14 | 14 | | the municipality: |
|---|
| 15 | 15 | | (A) [(1)] has a population of more than 50,000; |
|---|
| 16 | 16 | | and |
|---|
| 17 | 17 | | (B) [(2)] is located wholly or partly in: |
|---|
| 18 | 18 | | (i) [(A)] a county with a population of |
|---|
| 19 | 19 | | more than three million; |
|---|
| 20 | 20 | | (ii) [(B)] a county with a population of |
|---|
| 21 | 21 | | more than 400,000 [275,000] that is adjacent to a county with a |
|---|
| 22 | 22 | | population of more than three million; or |
|---|
| 23 | 23 | | (iii) [(C)] a county with a population of |
|---|
| 24 | 24 | | more than 1.4 million: |
|---|
| 25 | 25 | | (a) [(i)] in which two or more |
|---|
| 26 | 26 | | municipalities with a population of 300,000 or more are primarily |
|---|
| 27 | 27 | | located; and |
|---|
| 28 | 28 | | (b) [(ii)] that is adjacent to a |
|---|
| 29 | 29 | | county with a population of more than two million; or |
|---|
| 30 | 30 | | (2) in the corporate boundaries or extraterritorial |
|---|
| 31 | 31 | | jurisdiction of a municipality with a population of 1.9 million or |
|---|
| 32 | 32 | | more. |
|---|
| 33 | 33 | | SECTION 2. The change in law made by Section 212.0155, Local |
|---|
| 34 | 34 | | Government Code, as amended by this Act, applies only to an approval |
|---|
| 35 | 35 | | of a plat filed: |
|---|
| 36 | 36 | | (1) on or after the effective date of this Act; or |
|---|
| 37 | 37 | | (2) before the effective date of this Act if the plat |
|---|
| 38 | 38 | | has not received final approval before the effective date of this |
|---|
| 39 | 39 | | Act. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2011. |
