99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the applicability of the Education Code to Head Start
1212 programs and the authority of the commissioner of education to make
1313 a certain determination regarding those programs.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 4, Education Code, is amended by adding
1616 Section 4.003 to read as follows:
1717 Sec. 4.003. APPLICABILITY TO HEAD START PROGRAMS. A
1818 provision in this title applies to a Head Start program only to the
1919 extent that the provision explicitly provides for that
2020 applicability.
2121 SECTION 2. Subsection (b), Section 7.031, Education Code,
2222 is amended to read as follows:
2323 (b) Unless otherwise prohibited by federal law, the
2424 commissioner may determine[, solely for purposes of the program's
2525 eligibility to receive federal grant funds, for the purpose of
2626 technology services and support,] that a Head Start program
2727 operated in this state by a school district or a community-based
2828 organization serves the function of an elementary school by
2929 providing elementary education at one or more program facilities,
3030 regardless of whether the Head Start program facilities are located
3131 on a school district campus.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2011.
