| 11 | 11 | | relating to the applicability of the Education Code to Head Start |

| 12 | 12 | | programs and the authority of the commissioner of education to make |

| 13 | 13 | | a certain determination regarding those programs. |

| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Chapter 4, Education Code, is amended by adding |
|---|
| 16 | 16 | | Section 4.003 to read as follows: |
|---|
| 17 | 17 | | Sec. 4.003. APPLICABILITY TO HEAD START PROGRAMS. A |
|---|
| 18 | 18 | | provision in this title applies to a Head Start program only to the |
|---|
| 19 | 19 | | extent that the provision explicitly provides for that |
|---|
| 20 | 20 | | applicability. |
|---|
| 21 | 21 | | SECTION 2. Subsection (b), Section 7.031, Education Code, |
|---|
| 22 | 22 | | is amended to read as follows: |
|---|
| 23 | 23 | | (b) Unless otherwise prohibited by federal law, the |
|---|
| 24 | 24 | | commissioner may determine[, solely for purposes of the program's |
|---|
| 25 | 25 | | eligibility to receive federal grant funds, for the purpose of |
|---|
| 26 | 26 | | technology services and support,] that a Head Start program |
|---|
| 27 | 27 | | operated in this state by a school district or a community-based |
|---|
| 28 | 28 | | organization serves the function of an elementary school by |
|---|
| 29 | 29 | | providing elementary education at one or more program facilities, |
|---|
| 30 | 30 | | regardless of whether the Head Start program facilities are located |
|---|
| 31 | 31 | | on a school district campus. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2011. |
